I/We understand that there are certain risks of injury inherent in any sports activity. In consideration of my, or my child or ward’s participation and/or attendance at a Zoned Inc. (Zoned) off premises event, facility, venue, competitive or training program, I agree to assume the risks incidental to such participation and use (which risks may include, among other things, muscle injuries, bruises, lacerations, broken bones, etc.) and, on my own or my child or ward’s behalf, and on behalf of my or my child or ward’s heirs, executors and administrators, I hereby release and forever discharge Zoned Inc., its officers, owners, shareholders, coaches, employees, supervisors, volunteers, facilities owners or managers, representatives, instructors, and any anyone else associated with Zoned activities, of and from all liabilities, claims, actions, damages, costs or expenses of any nature arising out of or in any way connected with my or my child or ward’s participation and attendance in activities previously stated, and further agree to indemnify and hold each of the Stated Parties harmless against any and all such liabilities, claims, actions, damages, costs, or expenses including, but not limited to, all attorney's fees and disbursements. I understand that this Release and Indemnity Agreement includes any claims based on the negligence, action or inaction of any of the above Released Parties and covers bodily injury (including death) and property damage, whether suffered by me, or my child or ward, before, during or after such participation or attendance. I declare that I, or my child or ward, are physically fit and have the skill level required to participate in Zoned activities. I further authorize Zoned personnel to take whatever judgments they deem necessary to provide medical treatment for myself, or my child or ward, at my cost and risks, if the need arises.

I further grant Zoned, the right to photograph and/or videotape me or my child or ward and further to display, and/or otherwise use my or my child’s or ward’s name, face, likeness, voice, and appearance forever and in all media, whether now known or hereafter devised, including, without limitation, in online webcasts, television, motion pictures, films, newspapers, and magazines) and in all forms including, without limitation, digitized images, whether for advertising, publicity, or promotional purposes, including, without limitation, publication of event results and standings, or for any other purposes whatsoever, without compensation, reservation or limitation. Zoned, however, is under no obligation to exercise said rights herein granted. This Agreement shall be governed by the laws of the State of New Jersey.

Assumption of Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization.  COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Zoned Inc. cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, participating at Zoned Inc. or any activities or teams associated with Zoned Inc. could increase your risk and your child(ren)’s risk of contracting COVID-19.  By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by participating at Zoned Inc. and that such exposure or infection may result in personal injury, illness, permanent disability, and death.  I understand that the risk of becoming exposed to or infected by COVID-19 with my participation may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Zoned Inc. coaches, volunteers, and program participants and their families.  I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s participation with Zoned Inc. programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Zoned Inc , its employees, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Zoned Inc, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Zoned Inc. activity.

I specifically certify that I am the parent or guardian. I certify that I have read, understand and accept this Waiver and Release in its entirety.
