is aware and agrees to the below terms and conditions on behalf of your child.

You are aware that the use of the premises and its facilities by your child and their participation in classes and programs conducted by Trainer may involve strenuous activity and special risks.

You warrant that he/she is physically able to participate in any classes/fitness program or use any studio facilities in which they have chosen to participate and have not been advised otherwise by a medical practitioner.

You understand that he/she will be engaging in activities that may involve risk of personal injury or illness and which may also involve the risk of economic/property loss and damage.

You also understand that there may be risks involved for your child that are not known to you or the Trainer, or that may not be foreseen or reasonably foreseeable at this time or at the time of using the studio facilities or participating in the class/fitness program.

You assume the foregoing risks including risk of any negligence by Trainer and its respective owners, directors, officers, employees or agents, and accept personal responsibility for any injury (including but not limited to personal injury and disability), illness, damage, loss, claim, liability or expense of any kind or nature, that you may suffer arising out of or in connection with the use of studio facilities, or participation in classes/fitness programs by you, or any minor/person under your supervision, care or control.

You warrant that your child is in reasonable physical condition and that you have advised the Trainer any Medical Conditions, and any physical, mental or emotional health issues or other reasons (that you are aware of) why he/she cannot or should not take part in active or passive exercise.

If your child has an infection, cold, contagious illness or physical ailment such as an open sore or cut, or if there is any other risk of infection or illness, however small, to any other person, they are not permitted to use the studio facilities. You must advise the Trainer and reschedule the session.

Any advice and/or recommendation by the Trainer is not intended to constitute medical diagnosis or treatment, nor should it be relied on as a suggested course of medical treatment for a particular condition. If you are in doubt, you must obtain medical advice prior to commencing or continuing any exercise program and advise the Trainer if your child feels any discomfort during or after a training session.

To the fullest extent permitted by law, you hereby release and forever discharge the Trainer from all actions, suits, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses howsoever arising that your child may have directly or indirectly incurred, arising from or in connection with them entering into this Agreement, and/or use of Trainer facilities and equipment, or from being on studio premises and whether caused or contributed to (directly or indirectly) by an act of negligence, breach of duty or default/omission on the part of the Trainer and its respective owners, directors, officers, employees or agents.

You agree that the Trainer will not be liable for any loss, damage or theft of any of your child's (or your guest’s) property except where caused directly by the gross negligence of the Trainer.

To the full extent permitted by law, the Trainer will not be liable for any death, personal injury or illness occurring on studio premises or as a result of use of facilities or equipment, except to the extent that it arises from the gross negligence of the Trainer and its respective owners, directors, officers, employees or agents.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization​. COVID-19 is extremely contagious ​and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. The Optimal Lab ​have done its best to put in place preventative measures to reduce the spread of COVID-19; however, The Optimal Lab cannot guarantee ​that you will not become infected with COVID-19.

Further, attending The Optimal Lab could ​increase​ ​your childs risk of contracting COVID-19. By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that your child may be exposed to or infected by COVID-19 by attending The Optimal Lab and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You understand that the risk of he/she becoming exposed to or infected by COVID-19 at The Optimal Lab may result from the actions, omissions, or negligence of your child and others, including, but not limited to, The Optimal Lab employees and program participants. You voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to your child (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that you may experience or incur in connection with your attendance atThe Optimal Lab (“Claims”).

You hereby release, covenant not to sue, discharge, and hold harmless The Optimal Lab, its employees, agents, and representatives, from the Claims. You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of The Optimal Lab, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any The Optimal Lab program.

Should your child be in contact with someone who may have COVID-19 please advise The Optimal Lab Management Team as soon as possible so a plan of action can be determined.

I consent to allow The Optimal Lab to collect my child's photograph, by capturing their image at the studio for identifying him/her as a member in our booking system. The Optimal Lab Team periodically takes pictures and video of our members and persons participating in classes to use for promotional purposes and programming materials including social media and The Optimal Lab website.

Any minors below the age of 15 must be accompanied by an adult at all times while using The Optimal Lab studio and its facilities.
