1. VOLUNTEER ROLE: I have voluntarily agreed to serve as a volunteer for Comfort Cases. All the work I do is on a volunteer basis, and I am not eligible to receive any payment or monetary reward. I understand that I may only participate in volunteer activities authorized by Comfort Cases, as directed by a shift supervisor or other authorized representative of Comfort Cases. Any additional activities that I want to perform on behalf of Comfort Cases must be approved by an authorized representative before I participate in the activities.

2. POLICIES AND PROCEDURES: I have read and understand the Volunteer Policies and Procedures. I agree to comply with the Volunteer Policies and Procedures, and with other policies and procedures that apply to me in my role as a volunteer for Comfort Cases.

3. PRIOR CONDUCT: I confirm, represent and warrant that I have never been convicted of, or charged with, a violent crime, or any crimes involving children, such as child abuse or neglect, child pornography, child abduction or kidnapping, and that I have never been ordered by a court to receive psychiatric or psychological treatment in connection with any such conduct.

4. USE OF IMAGE; MATERIAL CREATED FOR COMFORT CASES: I understand that as a volunteer for Comfort Cases, I may be photographed or recorded on film, video or other media formats. I give Comfort Cases permission to use my name, photograph and likeness, in any and all forms now or hereafter known (the “Images”), for advertising or promotional purposes, and for any other lawful purposes related to the work of Comfort Cases. I acknowledge and agree that Comfort Cases will own all rights, title and interest in the Images, including the right to register any copyrights. I hereby waive and release any claim I may have based on any use of the Images. I also understand that all work product I create in my capacity as a volunteer for Comfort Cases will be the property of Comfort Cases and that Comfort Cases will have the sole right to use, sell, license, publish or transfer any such work product, in any and all media formats. I will disclose any such work product to Comfort Cases and assign all rights in the work product to Comfort Cases.

5. RESPONSIBILITY FOR MY OWN ACTIONS: I agree that I will be legally and financially responsible for my own acts and omissions relating to my service as a volunteer for Comfort Cases, and that I will indemnify and hold harmless Comfort Cases, and its successors and assigns, for these acts and omissions. I acknowledge that I am responsible for providing any medical, liability and auto insurance of my own during my volunteer service. I understand that I am not insured by Comfort Cases during the performance of my volunteer duties, including when driving a vehicle, unless Comfort Cases informs me otherwise in writing, and that I am not covered by workers’ compensation.

6. ASSUMPTION OF RISK: I am volunteering for Comfort Cases at my own risk. I agree to accept any and all risks of harm, injury, death or damage to myself or my property. I also hereby and forever release, discharge and hold harmless Comfort Cases (including its successors and assigns), and its directors, officers, employees and agents, from any claims that may arise on account of any first aid or medical treatment given to me in connection with my service as a volunteer for Comfort Cases.

7. WAIVER AND RELEASE: I agree that: (a) I will not sue or make a claim against Comfort Cases (including its successors and assigns), or its directors, officers, employees or agents, for any injury, damage or other loss, whether caused by negligence or otherwise, that may arise as a result of or relating to my volunteer service for Comfort Cases; and (b) my relatives, heirs, assigns and legal representatives will not sue or make any such claim. On their behalf, and on my own behalf, I hereby and forever release, discharge and hold harmless Comfort Cases (including its successors and assigns), and its directors, officers, employees and agents, from any and all liability, suits, claims and demands of whatever kind, that may arise as a result of or relating to my volunteer service for Comfort Cases, to the fullest extent permitted by law.

I understand that this release discharges Comfort Cases, and its directors, officers, employees and agents, from any liability or claim that I may have as a result of or relating to my volunteer service for Comfort Cases, whether caused by negligence or otherwise, including with respect to any bodily injury, personal injury, illness, death or property damage. I understand that Comfort Cases does not assume any responsibility or liability for any such occurrence, and does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury or illness.

I understand that this release is intended to be as broad and inclusive as permitted by the laws of Maryland. If, for any reason, Section 8 below is deemed unenforceable and this agreement is construed in accordance with the laws of California, I understand and agree that I am expressly waiving any and all rights I may have under Section 1542 of The Civil Code of the State of California, which states: “A general release does not extend to claims which a creditor does not know or suspect exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” I understand and acknowledge that the significance and effect of this waiver of Section 1542 is that, even if I should, in the future, discover damages arising out or relating to my volunteer service for Comfort Cases, I will not be able to make a claim for those damages.

8. GOVERNING LAW: This agreement will be governed by and construed in accordance with the internal laws of Maryland, without regard to the laws of any other jurisdiction that may apply because of Maryland conflicts of laws principles.

9. EFFECTIVE DATE: This agreement will be effective as of the first day of my service as a
volunteer, even if that date is before I sign this agreement.

As the parent/guardian of the Volunteer named below, I give my permission for the Volunteer to serve as a volunteer for Comfort Cases. I hereby acknowledge, confirm and agree to the terms of the Volunteer Agreement, including the waiver and release of liability, with respect to the Volunteer.
