Employers are required to inform the government about terminating a foreign national employee. Employers may choose to do so on the day of termination or within 90 days of terminating the employment. The attorney who filed the H-1B needs to notify USCIS.

Most employers want to register employees for the H-1B lottery as soon as the registrations open. H-1B registration and lottery takes place once a year.

Does your company want to implement a "payback agreement" as allowed under the law for immigration expenses? *
Payback agreement can be made between the foreign national employee and employer suggesting that if the employee leaves the company voluntarily within a certain time frame of getting an immigration benefit, the employer is entitled to request a payback of certain amount for added administrative cost of the immigration process.
