I the undersigned agree to the waiver terms stated below for the Detroit Cricket League 2024 season. I, also certify that I am aware of the Detroit Cricket League rules concerning team composition and that once registered with a team, I will not be able to play for any other team during 2024 season. I understand that only the very first registration request will be entertained by Detroit Cricket League.
In exchange for the opportunity to voluntarily participate in the Detroit Cricket League 2024 season, I agree that I’m 18 years old or older and I understand that there is a risk that the participant may incur or suffer illness, personal injury or other damages while attending and/or participating in such events. In consideration of the participant being permitted to attend and/or participate in any event directed by Detroit Cricket League, I on behalf of myself waive, release, and forever discharge any and all rights and claims for damages that may arise now or in the future against Detroit Cricket League and its sponsors and facilities in which any event directed by Detroit Cricket League is held (“Released Parties”), including Released Parties' owners, officers, directors, employees, committee members, representatives, and assigns, for any personal injury, illness, or damages that I may incur or suffer as a result of my attendance or participation in any event activity directed by Detroit Cricket League.
I acknowledge that I will be responsible for paying for any medical treatment that I may receive because of injuries or illness suffered during my attendance and/or participation in any event directed by Detroit Cricket League. Should the Participant(I) be injured or become ill during my attendance and/or participation in any event directed by Detroit Cricket League and I am not immediately available, I authorize Detroit Cricket League to seek emergency medical attention on my behalf.
I further accept that I will not hold Detroit Cricket League responsible for any damage to my personal belongings and effects including, but not limited to, damage to or loss of clothing, equipment, eyeglasses, protective gear or any sporting gear etc. . I also authorize Detroit Cricket League to penalize or impose fines upon me or our team should there be any damage to the facility or property where I or Our team played the game.
I authorize Detroit Cricket League to take, record, use, and broadcast or publish photographs, videotape or audiotape of the Participant in any media and for any lawful purpose whatsoever, including promotion or publicity of any event activity directed by Detroit Cricket League. I waive any right of the Participant or I may have to approve the finished product and/or use of such materials and to receive any royalties, profits or proceeds from such materials or finished product.

FACILITIES USE AGREEMENT, WAIVER AND INDEMNITY AGREEMENT the Common Elements in any manner inconsistent with the ordinances of the City of where game is being played, State and Federal laws and regulations, or in any manner which will interfere with or impair the rights of any other Co-owner in the use and enjoyment of their Unit or the Common Elements. The novel coronavirus (“COVID-19”) pandemic presents a unique and unprecedented safety challenge. Use of the Common Elements, particularly without appropriate social distancing measures, could lead to transmission of COVID-19.
WAIVER AND INDEMNITY AGREEMENT
Detroit Cricket League, has is requiring the use of this Facilities Use Agreement, Waiver and Indemnity Agreement (the“Agreement”) in order for a player, committee member or umpire (here by called participant) and a participant’s guest to use the facility (including its play area, restrooms and in consideration for the Detroit cricket League's opening the Detroit cricket League's rented Facilities for the participant or their Guest,
and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, the undersigned participant, Guest and Guardian agree to the following terms and conditions:
1. Each participant, Guest and Guardian acknowledge that it is their responsibility to consult with a physician before using the Detroit cricket league's rented Facilities. Each participant, Guest and Guardian represents and warrants that all of the undersigned are sufficiently healthy to use the Facilities and none of the persons in their group that use the Facilities have a cough, shortness of breath, chills, muscle pain, headache, sore throat, loss of taste or smell, diarrhea, extreme fatigue or have knowingly come into contact with a person diagnosed with COVID-19 in the past fourteen (14) days. Any person that presently has cough, shortness of breath, chills, muscle pain, headache, sore throat, loss of taste or smell, diarrhea, extreme fatigue or has knowingly come into contact with a person diagnosed with COVID-19 in the past fourteen (14) days shall not be allowed to use the Association Facilities.
2. Each participant, Guest and Guardian agree that they will comply with all local ordinances, state law, executive orders, Detroit cricket league's rules enacted by the city facility when using the city's Facilities and other common elements. The undersigned player, participant, Guest and Guardian acknowledge that under the Michigan Department of Health and Human Services Gatherings and Face Mask Order will be followed during the course of the game. The current capacity restriction is subject to change based upon the requirements imposed by the applicable governmental body. In addition, each participant will be responsible for providing accurate contact tracing information, as required, in order to create a record of the date and time of entry, and provide the names of participants, Guests or Guardians and their contact information, in order to aid with contact tracing. participants, Guests, or Guardians who refuse to provide their name and phone number will be denied participation in further games. Each participant, Guest and Guardian further agrees that they will not allow any person that is not part of their family or team to utilize the Facilities during the time that they are using the Facilities who is not authorized to use Facilities.
3. The Detroit Cricket League may, but is not obligated to, take such action as it deems appropriate to clean and sanitize the Common Elements. No representation or warranty is made that any cleaning or sanitation efforts undertaken by the Detroit Cricket League(City's rented facility) will prevent any damage, injury or loss, to person or property caused by any bacteria, biological or biochemical agent, chemical, disease, microorganism, pathogen, pollutant, toxin or virus, including, but not limited to, COVID-19. Each participant, Guest and Guardian assumes the risk of using the Detroit Cricket League's rented facilities, and other common elements, knowing that a bacteria, biological or biochemical agent, chemical, disease, microorganism, pathogen, pollutant, toxin or virus, including, but not limited to, COVID-19 that may cause bodily injury, sickness or death may be present within or on the Association Facilities or other Common Elements. Each participant, Guest and Guardian, waives any liability against the Detroit Cricket League, its agents, employees, volunteer board members, committee members or officers for any damage, injury or loss, to person or property, arising from or related to a bacteria, biological or bio-chemical agent, chemical, disease, microorganism, pathogen, pollutant, toxin or virus, including, but not limited to, COVID-19.
4. Each participant, Guest and Guardian shall indemnify, defend and hold harmless, the Detroit cricket league, its agents, employees, volunteer board members, committee members or fellow participant for any damage, injury or loss, to person or property, arising from or related to a bacteria, biological or bio-chemical agent, chemical, disease, microorganism, pathogen, pollutant, toxin or virus, including, but not limited to, COVID-19, that arise out of or relate during before or after the game played by any of the undersigned.
5. This Agreement constitutes the entire agreement of the Parties with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Agreement or the application thereof to any party or circumstance is held invalid, illegal, or unenforceable to any extent, then the remaining terms and provisions and their application to other parties or circumstances will not be affected thereby and will be enforced to the greatest extent permitted by law. All matters arising out of or relating to this Agreement will be governed by and construed in accordance with the internal laws of the State of Michigan excluding any conflict-of laws rule or principle that might refer the governance or the construction of this Agreement to the laws of another jurisdiction. Each Player/participants acknowledges that they have read and understands this Agreement, as well as the rules, regulations, guidelines, policies, and restrictions promulgated by the Detroit Cricket League governing the use of the rented facilities and that they knowingly and voluntarily agree to the terms and conditions stated above. NOTE: Each player must be registered with DCL at http://www.detroitcricketleague.org/ in order to participate in the official league and refer to the DCL Rules Book for further details. Captains or Players should always keep a copy of signed waiver form
