1.  In consideration for receiving permission to participate in the  KC CREW, LLC (hereinafter referred to as KCC), I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE KC Crew, the event volunteers listed in the Volunteer Spreadsheet, any of the participating locations listed in the Participating Locations Spreadsheet, their officers, agents, or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activity, while in, on  or upon the premises where the activities are being conducted, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law

2.  I am fully aware of the risks and hazards connected with the activities of KCC, and I am aware that such activities include the risk of injury and even death, and I hereby elect to voluntarily participate in said activities, knowing that the activities may be hazardous to my property and me.  I understand that RELEASEES do not require me to participate in this activity.  I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such an activities, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise, to the fullest extent allowed by law

3.  COVID-19: The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. It is believed that an individual can be in infected with COVID-19 without their knowledge and be asymptomatic. KCC has put in place preventative measures to reduce the spread of COVID-19. However, KCC cannot guarantee that I or anyone else will not become infected with COVID-19, including my spouse, guests, unborn child, or relatives. Participation in a KCC athletic sports program(s), related event, or activity, could increase the risk of contracting COVID-19. By signing this agreement, I ACKOWLEDGE the contagious nature of COVID-19 and VOLUNTARILY ASSUME THE RISK that I may be exposed to or infected by COVID-19 by participating in a KCC athletic sports program(s), related event, or activity, and that such exposure or infection may result in personal injury, illness, permanent disability, and death to myself, my spouse, guests, unborn child, or relatives. I understand that the risk of becoming exposed to or infected by COVID-19 at a KCC athletic sports program(s), related event, or activity may result from the actions, omissions, or negligence of myself or others, including, but not limited to, KCC employees, volunteers, and program participants. I UNDERSTAND AND VOLUNTARILY ACCEPT AND ASSUME ALL the foregoing risks related to COVID-19 and accept sole responsibility for any injury or illness that may occur. Further, I UNDERSTAND AND AGREE that this release includes any Claims based on the actions, omissions, or negligence of KCC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any KCC athletic sports program(s), related event, or activity.  

4. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage, or costs, including court costs and attorneys' fees that Releases may incur due to my participation in said activities, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES or otherwise, to the fullest extent allowed by law.

5.  It is my express intent that this Waiver and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above-named RELEASEES.  I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Maryland and that any mediation, suit, or other proceeding must be filed or entered into only in Maryland and the federal or state courts of Maryland. Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions.


IN ACCEPTING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Wavier of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least twenty-one (21) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.

KC Crew, LLC Declarations, Liability Release, Crawl Rules, Waiver of Liability, Assumption of Risk, Indemnity Agreement and Photography

DECLARATIONS: Must be 21 years old to participate and a valid State ID is required. KCC promotes safety and urges all participants to drink responsibly and use a designated driver. Participants must bring their photo ID to the registration venue. No refunds. Al sales are final. If a venue is at capacity then you may have to wait or proceed to another venue. Do not be late for registration. All Sales are final.

LIABILITY RELEASE: I AM IN NO WAY REQUIRED TO DRINK ALCOHOL AND SHOULD NOT DRINK TO THE POINT OF INTOXICATION. SHOULD I CONSUME ALCOHOLIC BEVERAGES I AM ENCOURAGED TO USE A DESIGNATED DRIVER. I RELEASE THE STAFF, OWNERS AND VOLUNTEERS OF THE KC CREW EVENT, AS WELL AS THE CLUB OWNERS AND ALL SPONSORS (HEREIN REFERED TO AS “RELEASED PARTIES” FROM ANY LIABILITY DUE TO MY PARTICIPATION IN THE KC Crew, INCLUDING CONSEQUENCES FROM MY CONSUMPTION OF ALCOHOL. I REALIZE EVENTS WHERE ALCOHOL IS BEING CONSUMED CONTAIN INHERENT RISKS AND THAT ACTIONS BY OTHERS WILL NOT BE HELD AGAINST THE STAFF, OWNERS, VOLUNTEERS, CLUB OWNERS AND SPONSORS OF THIS EVENT. I UNDERSTAND FULLY THE INHERENT RISKS INVOLVED IN THE KCC EVENT AND ASSERT THAT I AM WILLINGLY AND VOLUNTARILY PARTICIPATING IN THE EVENT I acknowledge that 1) I know the nature of the KCC event; 2) I understand the demands of this activity relative to my physical condition; and 3) I appreciate the potential impact of the types of injuries that may result from the KCC event. I HEREBY ASSERT THAT I KNOWINGLY ASSUME ALL OF THE INHERENT RISKS OF THE ACTIVITY AND TAKE FULL RESPONSIBILITY FOR ANY AND ALL DAMAGES, LIABILITIES, LOSSES, OR EXPENSES THAT I INCUR AS A RESULT OF PARTICIPATING IN THE TM EVENT. .... Initial Waiver of Liability for Ordinary Negligence In consideration of being permitted to participate in the KCC event, I (on behalf of the Releasing Parties) HEREBY FOREVER WAIVE, RELEASE, COVENANT NOT TO SUE, AND DISCHARGE KCC AND THE OTHER RELEASED PARTIES FROM ANY AND ALL CLAIMS RESULTING FROM THE INHERENT RISKS OF THE KCC EVENT OR THE ORDINARY NEGLIGENCE OF KCC (OR OTHER RELEASED PARTIES) THAT I MAY HAVE ARISING OUT OF MY PARTICIPATION IN THE KCC EVENT. In the event of an injury to me that renders me unconscious or incapable of making a medical decision, I authorize appropriate KCC personnel and emergency medical personnel at the event to make emergency medical decisions on my behalf (including, but not limited to CPR and AED). I authorize KCC to secure emergency medical care or transportation (i.e., EMS) when deemed necessary by KCC I agree to assume all costs of emergency medical care and transportation.

CRAWL RULES: Entry and Participation Agreements.

Rules: I agree to become familiar with and abide by all written and/or posted rules of KCC, as well as all written and/or posted rules of the Venue. I further agree to comply with all directions, instructions and decisions of KCC and Venue personnel. I further agree not to challenge these rules, directions, instructions, or decisions on any basis at any time.

Emergency Delay or Cancellation: I acknowledge that KCC at its sole discretion may delay, modify, or cancel the KCC event if conditions or natural or man-made emergencies make administering the event unreasonably difficult or unsafe. I agree that "emergency" is defined to mean any event beyond the control of KCC, including but not limited to: high wind, extreme rain or hail, hurricane, tornado, earthquake, flood, acts of terrorism, fire, threatened or actual strike, labor difficulty or work stoppage, insurrection, war, public disaster, and unavoidable casualty. In the event of a delay, modification, or cancellation of the TM event as described in this paragraph, I understand that I will not be entitled to a refund of my entry fee or any other costs incurred in connection with the TM event.

Govern Participation: I understand that KCC has the authority to issue instructions or directions relating to the manner of my safe participation in the Course or Related Activities and the authority to halt my participation in the Course or Related Activities at any time they deem it necessary to protect the safety of participants, spectators, and personnel.

Removal from CRAWL/EVENT: I understand that KCC and Venue personnel may immediately cause anyone who disobeys any rules, directions, instructions, decisions, or laws, or whose behavior endangers safety or negatively affects a person, facility, or property of any type or kind, to be removed from the KCC.

Fee Refunds: I understand that all fees and associated costs (including optional product purchases, spectator tickets, and donations), paid in registration for this KCC event are not refundable for any reason under any circumstances, including but not limited to injury, a scheduling conflict, and/or event cancellation.
Attitude and Behavior: I also agree to exhibit appropriate behavior at all times; demonstrate respect for all people, equipment, and facilities; and participate with a cooperative and positive attitude.

Legal Age: I affirm that I have reached legal age (or will have reached that age by the date of the KCC event. Legal age is 21.WAIVER:In consideration of permission to use, today and on all future dates, the property, facilities, staff, equipment, and services of KC Crew, LLC, I, for myself, my heirs, personal representatives or assignees, do hereby release, waive, discharge, and covenant not to sue the KC Crew, LLC, its directors, officers, employees, and agents from liability from any and all claims including the negligence of KC Crew, LLC resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in activities, activity programming, observation, and use of facilities, premises, or equipment.
ASSUMPTION OF RISKS: Physical activity, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. KC Crew, LLC has facilities for, and provides for sporting competition, which places stress on the cardiovascular and musculoskeletal systems. The specific risks vary, but the risks range from: 1) minor injuries such as scratches, cuts, bruises, strains, and sprains 2) major injuries such as eye injury or loss of sight, major joint or back injuries, major blood loss, bone fractures, heart attacks, strokes, and concussions to 3) catastrophic injuries including paralysis and death.  The social and economic losses and/or damages, which could result from these risks or dangers described above, could be severe.  Additionally there may be other risks not known to us or that are not reasonably foreseeable at this time.
INDEMNIFICATION AND HOLD HARMLESS: I also agree to INDEMNIFY AND HOLD KC Crew, LLC HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees brought as a result of my involvement at KC Crew, LLC and to reimburse them for any such expenses incurred.

SEVERABILITY: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as permitted by the law of the State of Missouri and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Photography: I understand that any and all photographs, motion pictures, recordings, and/or likenesses of me captured during the event by KCC, its affiliated entities or contractors, and/or the media become the sole property of KCC. I grant the right, permission and authority to KCC to use my name and any such photographs, motion pictures, recordings, and/or likenesses for any legitimate purpose, including but not limited to promoting, advertising, and marketing  activities. I further understand that KCC, as sole owner, has the full right to sell and/or profit from the commercial use of such photographs, motion pictures, recordings, and/or likenesses.
