Safeguarding Civil Liberties Support Sign On Letter
California Health Coalition Advocacy has proposed legislation that would bring a balance between public health and the rights of the individual to make their own choices about their health.
 
Any action taken by the health department to ascertain the nature of a disease, and to prevent its spread, can only be carried out with the prior, free and informed consent of the person concerned or their guardian, based on adequate information as is stated in the Universal Declaration of Bioethics and Human Rights.
 
During emergencies and infectious disease outbreaks, the government or its designees may not take away a person’s fundamental right to make health decisions for themselves or for their dependents. They may not take away a person’s ability to receive benefits and/or fully participate in necessary and important services such as education, daycare, employment, and religion based on a person choosing to decline preventive, diagnostic and therapeutic medical treatment or intervention.
