This Release of Liability & Photo Waiver (“Release”) is given in favor of CREATIVE LEARNING ALLIANCE, INC., a Missouri nonprofit corporation, and its directors, officers, employees, volunteers, agents, chapters, assignees, licensees, and cooperating entities (collectively, the “Organization”). I or my child desires to participate in the activities of the Organization. In exchange for being allowed to participate in the activities and for other good and valuable consideration, the receipt, and sufficiency of which I acknowledge, I freely and voluntarily sign this Release.
ASSUMPTION OF RISK & RELEASE OF LIABILITY
I am aware and understand that some of the activities may be inherently dangerous and may expose me or my child to a variety of foreseen and unforeseen hazards and risks. I acknowledge that I, or my child, am voluntarily participating in the activities and I/we have considered those risks. I hereby expressly and specifically assume such risks, including any and all risk of injury, harm, or loss that I or my child may incur as a result of participation in the activities of the Organization.
I, on behalf of myself/my child, and for my/my child’s heirs, executors, administrators, assigns, and all legal guardians, hereby RELEASE AND FOREVER DISCHARGE the Organization, and its representatives, heirs, executors, administrators, successors, and assigns (collectively, “Released Parties”), from ANY AND ALL CLAIMS, DEMANDS, RIGHTS, CAUSES OF ACTION AND LOSSES (collectively, “Claims”) OF ANY KIND WHATSOEVER THAT I OR MY CHILD NOW HAVE OR LATER MAY HAVE AGAINST ANY RELEASED PART IN ANY WAY RESULTING FROM OR ARISING OUT OF OR IN CONNECTION WITH MY PARTICIPATION IN THE ACTIVITIES OF THE ORGANIZATION, TO THE EXTENT ALLOWED BY LAW, WHICH MAY INCLUDE BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR PROPERTY LOSS. I acknowledge and understand that this Release EXTENDS TO AND RELEASES AND DISCHARGES ANY AND ALL CLAIMS I, or my child, have or may have against the Released Parties arising out of my participation in the Organization’s activities, including without limitation, all such claims resulting from the NEGLIGENCE of any of the Released Parties or otherwise. I understand this Release will extend to bind my spouse, heirs, and assigns. I agree not to sue and not to make or bring any such claim or demand against the Released Parties.
PHOTOGRAPHIC AND OTHER MEDIA RELEASE
I understand and agree that during the activities, I/my child may be photographed and/or videotaped by the Organization for internal and/or promotional use. I, on behalf of myself/my child, hereby grant and convey to the Organization all right, title, and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consent to the Organization’s use and reproduction of my/my child’s name, image, likeness, biographical information, and voice in perpetuity, in any medium or format, for any publicity, education, fundraising, or other purposes without further compensation or permission. Finally, I (I, on behalf of my child) agree that I will not seek at any time to receive any financial benefit or compensation in connection with such media, other than the consideration already provided under this Release.
This document shall be binding upon me, (my) (my child’s) heirs, executors, administrators, assigns, and all legal guardians (of my child). This Release is intended to be as broad and inclusive as permitted and shall be governed by and interpreted by the laws of the State of Missouri, without reference to any choice of law doctrine.
By signing this form, I acknowledge that I am over 18, have read this release before signing below, I understand and agree to the contents of this Release, and am not relying on any other statements or representations of any Released Party.
