Terms: the artist (me), the client (commissioner, you)

The terms mentioned here apply to all current commissioned artworks. It is the client’s responsibility to read and understand these terms as they are displayed publicly. These Terms & Conditions apply to both the artist and the client. Should there be any breach on part of the artist, the client will be entitled to a refund on a case by case basis as delineated below.


Usage of works
unless stated otherwise, the artist reserves the right to post a copy of the artwork to his own galleries


the artist reserves the right to not allow the artwork to be converted for anyone's (the client included) monetary gain outside of the artwork's intended purpose. (ie. converting the artwork into prints, mugs, t-shirt / hoodie, etc.)


 in the event, the client would like the artwork to be converted for monetary gain, the client may seek to commission the artist for that specific project or negotiate with the artist.


the client may edit (crop sections) of the artwork for use as banners, avatars / etc.


the client is allowed to upload the work to any of the client's sites. any uploaded artwork must be credited to the artist.


the client is not allowed to have finished artwork be completed by another artist without permission from the artist (me).
Communication
for more complete works (ie. fully shaded with complex backgrounds) the artist will update the client through e-mails showing WIP. the client is encouraged to also check in on the artist regarding work status using e-mails.
Rejection & Refund


 the artist reserves the right to reject the client's commission work at any stage. If payment has already been made, a portion of the payment will be refunded relative to the amount of work completed. (ie. artwork is 80% done, so only 20% of the payment will be refunded)


 the artist reserves the right to hold onto the completed artwork indefinitely should the client be unable to pay.


the artist reserves the right to modify the artwork of the client for his own purposes (including reselling), should the client be unable to complete payment after the 10 day grace period.


 should the client want a refund, full or partial refunds are to be discussed on a case by case basis


Art process, Reference materials & Edits / Changes to commissioned artwork
 the client will be given a chance to review and request changes when the first draft has been e-mailed to the client.


 the client is not allowed to make massive changes after the first draft has been sent out. (ie. complete swapping of characters, adding extra characters suddenly, changing the entire background, sudden updating of reference materials.)


 all reference materials submitted to the artist during the first draft phase are taken as final. subsequent updating of reference materials after the first draft has been approved will be ignored.


 the client may send updated reference material only during the first draft phase.


any changes that must be made by the artist will either incur a charge depending on how much work is needed and may be subjected to rejection of commission.
 
In sending me any commission requests, you have made clear that you have read the Terms & Conditions and that you understand them.

As a creator, I feel it is important to be able to provide a fair deal for both the client and the creator. That said, I will always strive to provide the best possible work for the client and try to maintain a somewhat professional atmosphere.
