This WAIVER AND RELEASE is given by me, the undersigned, to Break Even Beermakers, LLC of Amador City, California, in consideration of my application and permitting me to participate in the Break Even Beermakers Autumn Roll-About Event on October 28th, 2023. I understand that biking involves risk, requiring me to exercise personal skill and balance. I understand that pedestrian and motor hazards are present, and that obstacles may exist. I agree to follow all traffic laws, signs, rules and regulations and fully assume all risk, including collision with pedestrians, vehicles, other riders and/or objects. I acknowledge that I have inspected and am fully satisfied with the condition of my bike and accept the inherent risk of biking, whether known or unknown, and agree that I will always wear a helmet while biking. I agree to supervise any persons under age 18 during any time that they use my bike. As a bicyclist, I acknowledge that I am responsible for the way I ride and the condition of my bike and take responsibility for any damage that may occur while riding. I, for myself, my executors, administrators, heirs, next of kin, successors, and assigns hereby waive, release, discharge and agree to defend, indemnify and hold harmless Break Even Beermakers, LLC of Amador City, California; Old Route 49, LLC of Amador City, California; the city of Amador City, California; TLC MHC Ranch, California Limited Partnership, of Sutter Creek, California; its managers, members, officers, directors, representatives, employees, volunteers and agents from any and all actions, claims, causes of action, expenses, damages and demands of any kind, including, but not limited to, any claim of damage for bodily injury, death or loss of personal property as a result of my use of my bike in the Autumn Roll-About Event. I am of legal age and fully competent. I have read this Waiver and Release and fully understand it.
