1. Introduction:
This agreement is entered into between the Beanie Love Foundation (hereinafter referred to as "BLF") and the named upon individual, (hereinafter referred to as "the Volunteer"). This document outlines the terms and conditions under which the Volunteer agrees to offer their services to BLF.
2. Volunteer Commitment:
The Volunteer agrees to commit their time, effort, and services to BLF in good faith, and to conduct themselves with integrity and in a manner that upholds the reputation and values of the Foundation.
3. No Compensation:
The Volunteer acknowledges and agrees that their services are offered on a voluntary basis, and they shall not receive any compensation, financial or otherwise, for their efforts, unless otherwise agreed upon in writing.
4. Health and Safety:
a. The Volunteer agrees not to attend any in-person events, meetings, or gatherings related to BLF while experiencing symptoms of illness, especially those consistent with contagious diseases.
b. If the Volunteer becomes aware that they have been exposed to a contagious illness, they must notify BLF immediately and refrain from attending any in-person BLF events until they have been cleared by a medical professional.
c. The Volunteer agrees to adhere to all safety protocols and guidelines established by BLF during in-person events.
5. Confidentiality:
Any information the Volunteer gains access to during their service, which is not publicly available or is deemed confidential, must not be disclosed to any third party without the express consent of BLF.
6. Media Release:
a. Permission: By signing this agreement, the Volunteer grants BLF the right to capture, use, and disseminate photographs, video recordings, and/or audio recordings that feature the Volunteer, taken during the course of their volunteer service.
b. Usage: These materials may be used for promotional, informational, and educational purposes including, but not limited to, publications, advertisements, brochures, social media, and website content.
c. Waiver: The Volunteer releases and forever discharges BLF, its agents, representatives, and employees from any and all claims and demands arising out of or in connection with the use of said photographs, videos, and/or audio recordings, including but not limited to, any claims for invasion of privacy or defamation.
7. Termination:
Both BLF and the Volunteer have the right to terminate this agreement at any time, with or without cause. Any breach of this agreement, including attending events while sick, may result in immediate termination of the Volunteer's association with BLF.
8. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Maricopa County, Arizona, USA.
9. Liability:
BLF shall not be held liable for any injuries, damages, or losses incurred by the Volunteer during the course of their volunteer work, unless such injuries, damages, or losses are directly caused by BLF's negligence.
10. Miscellaneous:
This agreement represents the entire understanding between BLF and the Volunteer and supersedes all prior communications, understandings, and agreements, whether oral or written.
