CONDITIONS OF PARTICIPATION:
1. GENERAL CONDITIONS
General conditions and instructions for sports and sports tourism programmes are an integral part of all activities, programmes and packages run by the sports agency KOFLER SPORT for various mutual and pre-agreed activities. They are part of the services/contract concluded by the sports agency Kofler Sport, Gregor Kofler s.p. (hereinafter: KOFLER SPORT) and the client (individual participants in a certain activity, group of individual participants in a certain activity, or a company, institution or various associations or societies, whose employees take part in any packages, programmes or activities on their own accord or through the company or business partners, and other travel agencies that sell KOFLER SPORT’s activities, packages or programmes to their guests through their networks as an authorised partner travel agency), who registers or books a certain activity, package or programme.

Clients may familiarise themselves with the provisions of the General Terms and Conditions (hereinafter: GTC) of KOFLER SPORT in its business premises and/or on its website www.kofler-sport.si, where the GTC are specifically marked on the link General conditions and are readily available. The price list of sports services activities forms an integral part of the GTC and can also be found on the website under the relevant individual services as well as in KOFLER SPORT’s business premises. Upon prior request, when sending an offer/contract, KOFLER SPORT may also send the client the GTC along with the offer/contract.

The activities, packages and programmes that are the subject of the GTC are related to KOFLER SPORT sports tourism.

A client is any person, company, association, institution, group of friends or travel agency, etc. who has made a valid reservation or has purchased and paid for a particular package, programme, activity or other KOFLER SPORT service. In the part related to the protection of personal data, the GTC also refer to users of the website www.kofler-sport.si. in so much as clients are familiarised with KOFLER SPORT’s GTC and it is considered that a client gives their irrevocable consent to KOFLER SPORT’s GTC when they meet at least one of the following conditions:

INDIVIDUAL PARTICIPANTS IN AN ACTIVITY: When by signing a mutual contract the client confirms that they have been familiarised with the GTC and that they irrevocably agree to them. When a client sends a written confirmation email stating their name, surname, chosen activity, arrival date and the number of participants to one of KOFLER SPORT’s email address. When booking and paying for a certain activity via the KOFLER SPORT website. When booking and paying via the KOFLER SPORT online application form.

COMPANIES, INSTITUTES, SOCIETIES or ASSOCIATIONS: When sending a written confirmation stating their chosen activity, package or programme to one of KOFLER SPORT’S email addresses, a company, institute, society or association must confirm that they have been familiarised with the GTC and that they irrevocably agree with them. They must also confirm that they have been familiarised with the GTC and that they irrevocably agree with them when transferring the agreed percentage of the value of the pre-agreed mutual transaction to KOFLER SPORT’S bank account.

TRAVEL AGENCIES: When sending a written confirmation (voucher or agency order form) stating their chosen activity, package or programme, the date of arrival and the number of participants to one of KOFLER SPORT’S email addresses. When a certain percentage is paid of the total amount of the transaction required to confirm and book the activity, programme or package.

The GTC also contain important instructions (STATEMENT OF RESPONSIBILITY AND CO-RESPONSIBILITY WHEN TAKING PART IN SPORTS ACTIVITIES), with which clients are familiarised prior to the start of each sports activity, and by signing confirm that they irrevocably agree with the conditions and that they will follow the rules and instructions of KOFLER SPORT and its staff during sports activities. Regardless of whether a client is an individual participant of part of a company, institution, association or agency, the instructions must be read and signed by all participants who will participate in a particular sports activity. If an individual (or more than one individual) does not want to sign or does not agree with the instructions, they cannot participate in the activity organised by KOFLER SPORT, regardless of whether the activity has been paid for in advance. Additionally, anyone who does not meet all the required regulations in the instructions will not be permitted to participate in the activity (see SAFETY DURING ACTIVITIES). Signatures are considered binding via email or directly when registering for the activity itself.

2. DEFINITION OF ACTIVITIES, PROGRAMMES AND PACKAGES

ACTIVITIES: these are sports activities that KOFLER SPORT runs through its own organisation or which it sub-contracts to other verified and equally licensed sports agencies. The activities that are carried out are: climbing, hiking, mountain guiding, cycling, day trips, children's activities, winter skiing activities, cross-country skiing, snowshoeing, transportation, hire of equipment and other requisites, as well as all other activities defined on the KOFLER SPORT website.

PROGRAMMES: these are one-day programmes for companies or groups, which KOFLER SPORT runs through its own organisation or sub-contracts to other verified and equally licensed agencies. They include one or more activities as well as food and drink and/or equipment hire or transportation.

PACKAGES: these are two- or multi-day packages that KOFLER SPORT runs through its own organisation or sub-contracts to other verified and equally licensed agencies.

3. SERVICES THAT ARE, AND ARE NOT, INCLUDED IN KOFLER SPORT’S ACTIVITIES, PROGRAMMES AND PACKAGES

The price of activities, programmes or packages includes all the services listed in the offer/contract and the application form that KOFLER SPORT sends to clients and which clients confirm by confirming their reservation.

Additional services are all services that are ordered in addition to a pre-agreed activity, programme or package. Additional services are not part of the offer/contract, therefore they must be paid separately in the form of a surcharge. Payment for additional services is made after the service has been provided and within 7 days of the client being issued an invoice by KOFLER SPORT. This includes, for example, food, drink, added individual or group activities. In some cases, food and/or drink may already be included in the offer – in such cases there are no extra charges for food and drink, unless the client ordered additional food and/or drink that was not part of the previously agreed offer/contract. Clients must confirm any additional services in writing prior to arrival, however, clients may also opt for additional services during the duration of the programme, package or activity.

Other services are services that are not part of the programme, but which are an integral part of the programme, e.g. guide accommodation and food on multi-day programmes, guides’ transport costs to a specific location where the activity, programme or package is carried out, transport of participants to the location if required by the client, etc. Other services are also paid for by the client if the KOFLER SPORT team, or part of it, has to temporarily relocate to the location where the activity, programme or package takes place in order to carry it out. Other services are listed in the offer/contract in the section headed: What isn’t included in the price.

Hidden costs are costs that agencies and companies typically charge without prior notice. These include various entrance fees, tips, unplanned visits to various shops that sell local products, etc. KOFLER SPORT does not apply hidden costs and never charges them.

4. BOOKINGS/RESERVATIONS AND PAYMENT

Clients can register or make a reservation at KOFLER SPORT’S premises, via the internet or by sending an e-mail to one of the company’s email addresses.
Upon making a booking or registering, both parties – KOFLER SPORT and the client – must confirm the reservation in writing by email, which counts as signing of a contract and is also confirmation of the reservation and contains information about the activity, programme or package for which the client has registered or refers to the name of the programme where this information is provided.

A client's booking/reservation is considered confirmed when it is confirmed in writing by KOFLER SPORT and providing at least one of the following conditions is met:

INDIVIDUAL PARTICIPANTS IN ACTIVITIES: When KOFLER SPORT sends the client an email confirmation stating the name of the desired activity, the date of arrival and the number of participants; when a client books and pays for a certain activity on the KOFLER SPORT premises or through the company’s website; when a client fills in the online application form and receives confirmation of a reservation; when a client sends confirmation of payment to the KOFLER SPORT bank account in order to confirm a booking for a predetermined activity, programme or package.

COMPANIES, INSTITUTIONS or ASSOCIATIONS: When KOFLER SPORT sends a confirmation email stating the date of the reservation and attaches a proforma invoice, on the basis of which KOFLER SPORT issues the client an invoice following completion of the selected activity, programme or package with a defined payment period. Proforma invoices contain the following information: number of people, date of the activity, package or programme and name of the offer/contract; when the agreed percentage of the total value of a pre-agreed mutual transaction is transferred to KOFLER SPORT’S bank account; when a client signs a mutual agreement for payment using a specific amount of compensation (vouchers, etc.) for a pre-agreed activity, programme or package. If a client does not provide the vouchers or other form of payment for the pre-agreed number of participants in a particular activity, programme or package, the client is considered to be at fault, therefore the previous conditions relating to the vouchers or other form of compensation (final amount of compensation) cannot be changed to the detriment of KOFLER SPORT. In no circumstances may the value of the vouchers or other form of compensation for the transaction be lower than the amount agreed.

TRAVEL AGENCIES: When sending a written confirmation stating the name of the desired activity, programme or package, the date of arrival and the number of participants to one of KOFLER SPORT’S email address (voucher or agency proforma invoice); when the agency pays a certain percentage of the value of the agreement that is required to confirm and book the activity, programme or package.

5. PRICES OF ACTIVITIES, PROGRAMMES AND PACKAGES

Prices are listed on KOFLER SPORT’S website, Facebook or Instagram profiles.
Bookings are only valid once payment of the FULL amount has been received.

ACTIVITIES:
The prices of sports activities are determined in advance and are published on the website kofler-sport.si under individual programmes or activities or other offers (the description of each activity includes a price), and during the summer on the premises of KOFLER SPORT.

PROGRAMMES AND PACKAGES:
The prices of programmes and packages are determined individually and depend on the content, duration and complexity of the programme or package. Full details of the prices for each programme and package are listed in each offer/contract separately.
KOFLER SPORT reserves the right to make changes to prices that may arise due to changes in market prices that affect the setting of the price of the activity, programme or package. Price increases and decreases are calculated at a percentage equal to the increase or decrease of pre-existing prices that were taken into account in the calculation.

KOFLER SPORT must notify clients of any changes in the price of an activity, programme or package at least 20 days prior to the start of the activity, programme or package. Clients should be informed in writing or in person. If the price increase exceeds 10%, the client has the right to terminate the contract without incurring any penalties. In such a case, KOFLER SPORT must refund the paid amount of the activity, programme or package. Any discounts and benefits are excluded and cannot be used in multiples. If several discounts are provided, upon booking, clients may select the best discount for their booking. In cases where individuals use discounts, the discount can only be used when paying in cash.

KOFLER SPORT and the client may also agree on mutual compensation (in the form of vouchers, etc.) during the preparation of an offer for the implementation of an activity, programme or package. Compensation must be financially evaluated and agreed in advance by KOFLER SPORT and the client. If a voucher cannot be used in full for a one-off event, vouchers for the agreed amount may be used over several pre-mutually agreed terms until the value of the voucher has been used. The use of vouchers as a form of compensation must be completed no later than two years after the conclusion of the compensation agreement, otherwise it is considered that the client is no longer interested in using vouchers as a form of compensation for payment, thus exempting KOFLER SPORT from the compensation agreement. In this case, the compensation is considered complete.

KOFLER SPORT may stipulate that a client must pay in person for a specific activity, programme or package, and in the manner stated in the programme. This applies to activities, programmes or packages that KOFLER SPORT does not run directly, but rather it directs clients to another provider. In such cases, KOFLER SPORT does not act as an organiser or intermediary, but rather only as a provider of information. In such cases, clients should make all complaints and demands for refunds on the spot on the premises of the agency or provider of a particular activity, programme or package.

6. SAFETY OF PARTICIPANTS DURING ACTIVITIES and STATEMENT OF RESPONSIBILITY

A brief overview of the instructions relating to responsibility and co-responsibility for sports activities, programmes and packages which each participant in sports activities, programmes or packages signs:
Participants are expected to be of psychophysical health and must not be under the influence of alcohol or other psychotropic agents. All participants must be of legal age and minors must be accompanied by an adult or have a written confirmation from their parents or guardians stating that they can participate in certain activities, while accepting responsibility and co-responsibility for sports activities, programmes or packages.

Restrictions on participation in activities:
The above restrictions apply to each activity, however, specific details regarding the number of participants and the age of the participants are listed separately for each activity or programme on the company’s website. KOFLER SPORT reserves the right to apply additional restrictions in the event of extreme weather conditions. KOFLER SPORT does not recommend that pregnant women and people with serious health problems or injuries take part in sports activities. KOFLER SPORT reserves the right to cancel or terminate an activity at any time in bad weather or due to other extraordinary circumstances. Upon cancellation of the trip, KOFLER SPORT will reimburse clients all booking costs, unless otherwise stated for individual activities in the application forms (depending on whether the activity has already begun, etc.). KOFLER SPORT reserves the right to cancel a trip even if the minimum required number of participants is reached. Following receipt of the obligatory equipment for sports activities (e.g. belaying equipment for via ferrata), in the event of cancellation (by the client), the client is not entitled to reimbursement. Additionally, reimbursements are not made in the event of any trips or activities being cut short due to the poor physical fitness of the individual. Sports activities takes place from the time of pick-up of guests at the agreed place until the end of the trip or activity at the agreed location. Each activity is defined separately.

Activities will be carried out at the location stated on the website on the basis of an agreement, application, Facebook, Instagram profile etc.
KOFLER SPORT and its guides have the right to postpone tours or activities due to bad weather and snow conditions. Participants’ opinions are not taken into account and are not a reason for the cancellation of a tour or activity. KOFLER SPORT is not responsible for any injuries sustained outside the duration of the activity, programme or package. KOFLER SPORT is not liable for any injuries that occur in contravention of the above provisions or due to non-compliance with the instructions of the guides or any of its other employees. Participants who have problems due to asthma or other health problems should inform the guide or other KOFLER SPORT employee prior to the start of the tour or activity. Any injuries that occur during an activity, programme or package must be reported immediately to the guide/instructor or other authorised person at KOFLER SPORT. KOFLER SPORT will not take into account any injuries reported subsequently.
Activities are led by qualified guides.


Participants must have the equipment that is listed on the website, Facebook or Instagram profile, or equipment suggested by the guide and communicated in writing to the registered participant.
In the event of an accident, the client will allow the guide to provide adequate medical care.

Participants must have appropriate health and accident insurance.
Participants must be insured for mountain rescue in Slovenia and abroad.
KOFLER SPORT photographs all participants in activities and thus reserves the right to use the photos for internal purposes. Photos taken by KOFLER SPORT are the property of KOFLER SPORT. The company does not assume any responsibility for lost, stolen or damaged personal items.

RESPONSIBILITY:
By signing this statement, the client declares the following in full awareness and responsibility and without coercion:
That I have been familiarised with information about the sports activities of the KOFLER SPORT sports agency:
which can be physically strenuous activities and that I perform at my own risk
that I am not taking part in activities under the influence of alcohol, drugs or other psychosomatic substances
that I am not taking part in activities in the event that I am being treated for any serious injuries (knee, spine, hip, shoulder, heart surgery…) without prior consent of my doctor
that I am familiar with the manner of carrying out the activities and will carry them out according to the instructions of the guide and the internal rules of the KOFLER SPORT sports agency, which I read prior to signing this statement or about which I was informed before and during the activity.
that in the event of injuries and their consequences, I will not file any claims against the KOFLER SPORT sports agency or against an individual guide for myself or those in my care due to my own negligence and the resulting injuries to myself, minors or third parties.

In the event of any special health or other conditions, clients must state the details at the top of the registration form, otherwise KOFLER SPORT considers that the client does not have any health problems.

In the event that a client has any chronic diseases or other serious types of health problems they must consult their doctor prior to performing any exercise or activities and bring a medical certificate confirming that they are fit to take part in the activity.

7. PAYMENT BY INSTALMENTS

More information is available at the premises of KOFLER SPORT or via email. Clients will be familiarised with all the options for making payment by instalments and, if required, an informative calculation will be prepared.

An administrative fee of EUR 25 per registration will be charged for each change of reservation.

8. USE OF DATA

All data on clients obtained by KOFLER SPORT are protected in accordance with the Personal Data Protection Act (Official Gazette of the Republic of Slovenia, No. 94/2007-UPB-1, hereinafter: ZVOP-1). By confirming a reservation, it is considered that the client also agrees to the use of their data for the purposes of statistical processing, market research, customer segmentation and notifications of special offers etc. If the client does not want to receive such information, they may state this when booking an activity, programme or package or at any time later.

9. CANCELLATION OF ACTIVITIES, PROGRAMMES OR PACKAGES BY A CLIENT

Clients have the right to cancel an activity, programme or package using the same means used to confirm the booking. Cancellations must be made in writing, otherwise cancellation of an activity, programme or package is not taken into account. If a client cancels an activity, programme or package, KOFLER SPORT has the right to reimbursement of costs due to the cancellation of the activity, programme or package. The amount of the reimbursement depends on when the client notified KOFLER SPORT of the cancellation. The date of written cancellation is the basis for calculating cancellation costs.

CANCELLATION OF ACTIVITIES, PROGRAMMES OR PACKAGES:

KOFLER SPORT has the right to charge or retain the following amounts in the event of cancellation by a client due to unsubstantiated reasons:
up to 30 days prior to the activity, programme or package, KOFLER SPORT will retain or charge 40% of the agreed price of the activity, programme or package
from 29 to 7 days prior to the activity, programme or package, KOFLER SPORT will retain or charge 50% of the agreed price of the activity, programme or package
from 6 to 1 days prior to the activity, programme or package, KOFLER SPORT will retain or charge 70% of the agreed price of the activity, programme or package
0 days prior to the activity, programme or package, KOFLER SPORT will retain or charge 100% of the agreed price of the activity, programme or package
non-participation without cancellation, KOFLER SPORT will retain or charge 100% of the agreed price of the activity, programme or package

The above conditions apply to all cancellations by a client due to unsubstantiated reasons. Payments for airline tickets are not refunded under this system, but rather following an assessment of the risk of cancellation at the time of purchase of airline tickets.

In the case of individual reservations, if a reservation is cancelled, clients must immediately notify KOFLER SPORT in writing within 24 hours of the occurrence of one of the reasons for the cancellation. In cases where the reason for cancellation is due to the deterioration of a client’s health, or that of a close relative (proof must be provided of close kinship), which prevents the client from participating in the activity, programme or package, the client must provide a doctor’s certificate. For cancellation due to health reasons, clients are reimbursed according to the following conditions:


In the event of a participant cancelling up to 30 days prior to the date of an activity due to a serious medical condition, for which they must provide a doctor’s certificate, 90% of the entire payment will be refunded (not including plane tickets). KOFLER SPORT retains the remainder of the payment to cover the cost of registration and reservations. Payment for air tickets is refunded according to the cancellation risk system.
In the event of a participant cancelling from 29 to 7 days prior to the date of an activity due to a serious medical condition, for which they must provide a doctor’s certificate, 85% of the total payment is refunded (not including plane tickets). KOFLER SPORT retains the remainder of the payment to cover the cost of registration and reservations. Payment for air tickets is refunded according to the cancellation risk system.
In the event of a participant cancelling from 7 days to the date of an activity due to a serious medical condition, for which they must provide a doctor’s certificate, 80% of the entire payment is refunded (not including plane tickets). KOFLER SPORT retains the remainder of the payment to cover the cost of registration and reservations. Payment for air tickets is refunded according to the cancellation risk system.

The above conditions apply to all cancellations by a client due to unsubstantiated reasons. Payments for airline tickets are not refunded under this system, but rather following an assessment of the risk of cancellation at the time of purchase of airline tickets.

In the event that there is a smaller number of participants than previously agreed for the activity, programme or package, the above-stated notice periods for the activity, programme or package shall be observed. If KOFLER SPORT has applied a group discount when calculating the price, it is considered void.
During the duration of an activity, programme or package, a client may terminate a certain activity, programme or package at their own request. In such cases, KOFLER SPORT and the client sign a written statement of termination stating the reason for the termination. If the client terminates the activity, programme or package, they are not entitled to a partial or full refund of costs or the purchase price.
Following confirmation of a reservation, clients may change the reservation, i.e. change the name of the client or the number of participants. In the event that a client wants to increase the number of participants, a written confirmation from KOFLER SPORT is required.

In the event of a cancellation when the client is a company, institution, association or society, the reason for the cancellation is thoroughly investigated.
If it is established that the client is not able to participate, the client and KOFLER SPORT agree on a new date under the same conditions as agreed upon the original confirmed reservation. Bad weather is not a reason for cancellation if KOFLER SPORT is able to ensure that the activity, programme or package can go ahead. If it is established that a cancellation is not justified, KOFLER SPORT issues the client with an invoice in the same way as for the service provided. In cases where a new date has been agreed, the client must send a written confirmation of the new mutually agreed date to KOFLER SPORT within 5 working days from the day when KOFLER SPORT sends the client the new mutually agreed date in writing. If the client does not confirm the new date within the agreed time, KOFLER SPORT may offer the newly agreed date to other customers.

KOFLER SPORT sends an invoice containing all the agreed services contained in the originally agreed reservation to the company, institution, association or society that cancels the booked activity, programme or package with the first booking date and the second agreed date or cancels it again. The date of written cancellation of the first reservation is the basis for drawing up the invoice.

If a cancellation is submitted by a company that has agreed to use compensation in the form of vouchers, etc. with KOFLER SPORT, the company is also offered a new date, which the client must confirm in advance. If the client does not apply the agreed compensation in the form of vouchers etc. within this new timeframe, the compensation is terminated and is considered as used. This is applied to ensure that KOFLER SPORT does not suffer any financial losses as a result of reserving dates that are then not used due to a client's non-attendance.

10. CANCELLATION OR MODIFICATION OF AN ACTIVITY, PROGRAMME OR PACKAGE BY KOFLER SPORT

In accordance with applicable law, KOFLER SPORT reserves the right to cancel or change an activity, programme or package in the following cases:
In the event of cancellation by KOFLER SPORT due to an insufficient number of registered participants (in the event that someone cancels in the period following payment up to the date of the activity) or due to special circumstances relating to KOFLER SPORT – illness, death, martial law or epidemic emergencies, etc. – within 30 days of the date of the activity, 90% of the amount will be refunded to the other participants. KOFLER SPORT retains the remainder to cover the costs of registration and reservation.

Payments for airline tickets are not refunded under this system, but rather following an assessment of the risk of cancellation at the time of purchase of airline tickets.

In the event of cancellation by KOFLER SPORT due to an insufficient number of registered participants (in the event that someone cancels in the period following payment up to the date of the activity) or due to special circumstances relating to KOFLER SPORT – illness, death, martial law or emergency epidemics, etc. – within 29 days to 7 days until the date of the activity, 85% of the amount will be refunded to the other applicants. KOFLER SPORT retains the remainder to cover the costs of registration and reservation. Payments for airline tickets are not refunded under this system, but rather following an assessment of the risk of cancellation at the time of purchase of airline tickets.

In the event of cancellation by KOFLER SPORT due to an insufficient number of registered participants (in the event that someone cancels in the period following payment up to the date of the activity) or due to special circumstances relating to KOFLER SPORT – illness, death, martial law or epidemic emergency, etc. – within 6 days of the date of the activity, 80% of the amount will be refunded to the other applicants. KOFLER SPORT retains the remainder to cover the costs of registration and reservation. Payments for airline tickets are not refunded under this system, but rather following an assessment of the risk of cancellation at the time of purchase of airline tickets.

If the running of an activity, programme or package would endanger the health or life of the participants, or if not enough people have registered for the activity, programme or package, KOFLER SPORT may cancel the activity, programme or package at least seven (7) days prior to the start and inform all those who have already made a reservation for the activity, programme or package and refund the purchase price in accordance with the above conditions, unless special circumstances have occurred within 6-1 days before the date of departure.

KOFLER SPORT reserves the right to withdraw from an activity, programme or package in full or in part if extraordinary circumstances occur during the running of the activity, programme or package that could not have been foreseen, removed or avoided, and for which KOFLER SPORT considers that these circumstances constitute a justified reason not to confirm the reservation in advance if information about the exceptional circumstances was available at the time of the conclusion of the contract. In such a case, KOFLER SPORT does not refund any prepaid purchase costs.

KOFLER SPORT reserves the right to withdraw from an activity, programme or package in full or in part if, prior to or during the activity, one or more participants or a client's guests directly violate the provisions set out in the General Terms and Conditions. In such cases, KOFLER SPORT does not refund any prepaid purchase costs.

KOFLER SPORT reserves the right to withdraw from an activity, programme or package in whole or in part if, prior to or during the running of the activity, programme or package, the competent person working and acting on behalf of KOFLER SPORT determines that a certain person/people taking part in the activity, programme or package is not/are not physically and/or mentally capable of the effort required by the activity, programme or package, and by continuing to take part would endanger their own health and that of others, and that this was not apparent or the client did not inform KOFLER SPORT about this prior to the start of the activity, programme or package. In such cases, KOFLER SPORT does not refund any prepaid purchase costs.

11. COMPLAINTS

Clients must report any irregularities or deficiencies on the spot to the leader of the activity, programme or package or the direct service provider.
If the cause of the complaint cannot be remedied, the client shall draw up a written complaint with the direct service provider or the leader of the activity, programme or package, which must be signed by the representative or service provider and the wronged party. The written complaint report is also an official document stating that the client had reason to complain about the service on the spot.
Any complaints must be substantiated. The client should therefore attach to the complaint any relevant evidence and/or the relevant confirmation of the guide, driver, caterer, hotelier, carrier or other relevant person relating to the factual situation on the basis of which the client asserts their claim and if it is related to a package sold by KOFLER SPORT the company is obliged to respond to the client in writing within 8 days of receipt of the complaint for the first time, and for the final time within the appropriate period necessary to obtain information on the cause of the complaint from the service provider, or in the time necessary to obtain information from third parties in accordance with Article 892 of the Code of Obligations. Until KOFLER SPORT issues a response, the client does not have the right to forward the complaint to any other person or judicial institution or to provide information to the media and other public. KOFLER SPORT will only deal with complaints in cases when it was not possible to remedy the situation on the spot.

12. HEALTH REGULATIONS

Prior to the start of the activity, programme or package, clients share a co-responsibility to assure KOFLER SPORT that none of the participants of the activity, programme or package have any medical conditions or restrictions that would prevent them from taking part in the activity, programme or package. Clients must be aware that all activities, programmes and packages run by KOFLER SPORT present an increased risk factor for injuries and other dangers, therefore under no circumstances should pregnant women or people with various back injuries, as well as those who have suffered other serious injuries or undergone surgery, take part in the activities, programmes and packages, and in such cases participants must consult a doctor beforehand. The activities, programmes and packages are also not suitable for people with high blood pressure and for those with heart problems. Persons with any such health problems are responsible for informing KOFLER SPORT at the time of booking or, if it was not possible, at the latest prior to the start of any activity, programme or package.

13. ACTIVITIES, PROGRAMMES OR PACKAGES IN WHICH KOFLER SPORT IS NOT THE ORGANISER

Where KOFLER SPORT is not the organiser of an activity, programme or package, it acts as an intermediary. In these cases, it provides clients with information received from the organiser and/or provider of the activity, programme or package and assists them in registering for the activity, programme or package. The conditions of registration, payment and possible cancellation of the trip are in accordance with the applicable conditions of the other organiser. Such programmes are specially marked, and a corresponding marker will also be made on the information about the activity, programme or package. KOFLER SPORT sells such arrangements in a foreign name and for a foreign account. Clients should direct any complaints to the organiser or provider of the activity, programme or package.

14. GIFT VOUCHERS

Gift vouchers are available from KOFLER SPORT. All gift certificates and other vouchers are valid from the date of issue until the date indicated on the voucher or coupon. Unless otherwise stated, gift vouchers can be redeemed at KOFLER SPORT until the expiration date for participation in an activity, programme or package. In the event of theft or other possible loss of a gift voucher, KOFLER SPORT is not liable. Vouchers cannot be exchanged for cash under any circumstances. The copying or reproduction of gift vouchers is prohibited and is a criminal offence. Only original KOFLER SPORT gift vouchers containing original signatures, stamps and other easily verifiable elements are valid.

15. FINAL PROVISIONS

Value added tax (VAT) is included in all the stated prices of KOFLER SPORT’S activities. Prices prepared for individual programmes and packages already include VAT. In the event of a dispute between parties, the district court shall have jurisdiction over all disputes. These General Terms and Conditions apply to all offers/contracts concluded from the date of publication on the website www.kofler-sport.si, where all changes are regularly updated and are always available in printed form at the premises of KOFLER SPORT.

EU GENERAL DATA PROTECTION REGULATION (GDPR)
GENERAL
Kofler Sport, sports agency, Gregor Kofler s.p., Kurirska pot 20, 4281 Mojstrana (hereinafter: the provider) is aware of the importance of personal data protection, so it has harmonised this area with the European Regulation EU 2016/679 on the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as the GDPR).

The provider’s main goal is to offer its clients the best possible service, thus achieving optimal satisfaction. For this purpose, the provider, with the help of the collected personal data that clients provide, is able to provide better and more relevant information about the products and services it offers.
The controller processes your personal data solely on the basis of your consent and only for the purpose or purposes for which you provided your personal data to the controller.

PERSONAL DATA
According to the GDPR, personal data means any information relating to an identified or identifiable individual.
The provider only collects and processes the personal data that clients provide when registering for a particular service or activity (subscribing to e-news or subscribing to advertised courses and other programmes offered by the provider). These personal data are: name and surname, post code and town/city, telephone number, name of the organisation or company, date of birth, gender, any medical requirements, email address and IP address.
In cases where a client provides information on behalf of someone else, they must ensure that the other party has been previously informed and made aware of this privacy notice. Clients who are under the age of 16 should only provide personal information if they have the permission of their parent or legal representative.
In order to keep the information up-to-date, the provider asks clients to inform it of any changes to their contact information.

PROTECTION OF PERSONAL DATA
The provider uses and processes personal data on the basis of valid Slovenian legislation and European Union law.
The provider, as the personal data manager, respects its clients’ privacy and undertakes to carefully protect all obtained personal data and not to pass it on to a third party without their consent or to use it for purposes other than the purposes for which the personal data was provided.

Personal data collected by the provider from clients may be transferred to third parties, provided that there is a legal basis for the transfer (a client’s explicit consent or legal provision).
All clients’ personal information is stored on the provider’s secure server or on the secure servers of the provider’s subcontractors or business partners (or in secure printed form), and the provider’s security policies and standards apply when accessing and using them.

Although it is not possible to provide complete protection against cyber attacks when transmitting data via the internet or a website, the provider, together with its subcontractors and business partners, strives to implement physical, electronic and procedural safeguards to protect clients’ data in accordance with applicable data protection requirements.
The provider has restricted access to clients’ data to those persons who need it for the purpose in question.

PERSONAL DATA RETENTION TIME
Personal data is retained by the provider only for as long as it is necessary for the purpose for which it was obtained, or as long as it is necessary for any other permitted related purpose (for example, if the data relates to the defence of a claim against the provider). Therefore, if the data is used for two purposes, the provider will keep it until the end of the longer term or longer duration expires, however, the data will no longer be used by the provider for the expired purpose.
Once the purpose has been fulfilled, the personal data you have provided to the controller will be deleted. If you provide personal data for the purpose of better information, they are collected and processed until your cancellation, which you can send at any time to the address info@kofler-sport.si

YOUR RIGHTS
By sending a written request to the provider’s email address, individuals may request access, supplement, correction, blocking or restriction of processing or deletion of personal data, object to the processing of their data or request transfer of data.

An individual may revoke the given consent to the processing of personal data permanently or temporarily, in whole or in part, by sending a written request to the provider’s address or may manage the given consents on the website where the consent was given: www.kofler-sport.si. Withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of the consent until its withdrawal.

With regard to the exercise of these rights, certain exceptions apply to the protection of the public interest (e.g. the prevention or detection of criminal offences), the provider’s interests (e.g. ensuring the protection of confidentiality) or the rights and freedoms of others. If a client exercises any of these rights, the provider will verify their eligibility and respond without undue delay and within one month at the latest. In complex cases or upon receipt of a large number of requests, this period may be extended for a further two months and the provider will notify the client of this extended period.

Individuals have the right to lodge a complaint with the Information Commissioner of the Republic of Slovenia if they consider that their personal data have been stored or otherwise processed in contravention of the applicable regulations governing the protection of personal data.
