Thank you for your interest in our swim clinic. Our open water swim clinic will be led by US Masters Certified Level 2 Swimming Coach Gina Rymal. At Tyler State Park. The clinic is limited to 9 swimmers to ensure safe social distancing. Safety swimmers are mandatory for all swimmers. Once your registration form is sent in we will send you a PayPal or Venmo form to confirm your payment.  If we can not hold the clinic this year due to COVID-19, you can still register knowing you will receive a full refund.

 I  intend to use some or all of the activities, facilities, programs and services offered at or by Fly Tri Racing, LLC. In consideration of being allowed such use, I do hereby waive, release and forever discharge  Fly Tri Racing, LLC and its officers, employees, agents, representatives and all others acting on its behalf from any and all claims or causes of action (known or unknown) for any and all injury, illness, damage or loss that may occur to me or my property as a result of my participation in any aspect of the activities, facilities, programs and services offered at or by Fly Tri Racing, LLC, including, but not limited to, my use of equipment or machinery in connection with the activities, facilities, programs and services offered at or by Fly Tri Racing, LLC and their agents, employees or representatives.. I understand that each person (myself included) has a different capacity for participating in such activities, facilities, programs and services. I am aware that all activities, facilities, services and programs offered are either educational, recreational or self-directed in nature. I agree that my participation in any and all of the activities, facilities, programs and services provided at or by Fly Tri Racing, LLC is strictly voluntary and has not been requested or required by Fly Tri Racing, LLC. I further agree that my participation in any and all activities, facilities, programs and services provided at or by Fly Tri Racing, LLC is at my own risk and that I assume any and all risk of injury, illness, damage or loss that might result. I also agree to assume all risk of damage, loss or theft to or of any of my personal property. I declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation in any of the activities, facilities, programs and services offered at or by Fly Tri Racing, LLC. I acknowledge that I have either had a physical examination and have been given a physician’s permission to participate in these activities, facilities, programs and services, or that I have decided to participate in these activities, facilities, programs and services without the approval of my physician. I do hereby assume all responsibility for my participation in the activities, facilities, programs and services offered at or by Fly Tri Racing, LLC and for my utilization of any and all equipment and machinery in connection with these activities, facilities, programs and services. I understand that the activities, facilities, programs and services offered by Fly Tri Racing, LLC may sometimes be conducted by persons who may not be knowledgeable, licensed, certified or registered instructors or professionals. I accept the fact that the skills and competencies of some of Fly Tri Racing, LLC employees, agents, representatives or volunteers will vary according to their training and experience and that no claim is made to offer assessment or treatment of any mental or physical disease or condition by those who are not duly licensed, certified or registered and employed to provide such professional services. *

Waiver of Liability, Indemnity Agreement, and Assumption of RiskWaiver: In consideration of permission to use, today and on all future dates the property, facilities, and services of the organization (hereafter Fly Tri Racing, LLC) I, on behalf of myself, my heirs, personal representatives, or assigns, do hereby release, waive, discharge, and covenant not to sue, Fly Tri Racing, LLC, its directors, officers, employees, volunteers, independent contractors, and agents from liability from any and all claims arising from the ordinary negligence of Fly Tri Racing, LLC or any of the aforementioned parties. This agreement applies to 1) personal injury (including death) from accidents or illnesses arising from the participation in Fly Tri Racing, LLC activities including, but not limited to, organized activities, classes, observation, and individualize of facilities, programs and services, on and off premises, or equipment; and to 2) any and all claims resulting from the damage to, loss of, or theft of property.Indemnification and Hold Harmless: I agree to HOLD HARMLESS ANDINDEMNIFY Fly Tri Racing, LLC from all claims resulting from negligence and to reimburse them for any expenses incurred by Fly Tri Racing, LLC in investigating and defending a claim or suit if my claim is withdrawn, or to the extent a court or arbitration determines that Fly Tri Racing, LLC is not responsible for the injury or loss. Severability and Venue: The undersigned further expressly agrees that the fore going waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of Texas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.Likewise, I agree that if legal action is brought, it must be brought in Texas.Acknowledgement of Understanding: I have read this waiver of liability andIndemnification agreement and fully understand its terms. I understand that I am I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law in the State ofTexas. *

Assumption of Risks: Physically activity, by its very nature, carries with it certaininherent risks that cannot be eliminated regardless of the care taken to avoid injuries.Fly Tri Racing, LLC has facilities for and provides for activities such as weight lifting, walking, jogging and running, aerobic activities, swimming, spinning and bicycling. Some of these involve strenuous exertions of strength using various muscle groups, some involve quick movements involving speed and change of direction, and others involve sustained physical activity, which places stress on the cardiovascular system.The specific risks vary from one activity to another, but in each activity the risksrange from 1) minor injuries such as scratches, bruises, and sprains to 2) majorinjuries such as loss of sight, joint or back injuries, concussions, and heart attacks to3) catastrophic injuries including paralysis and death.I have read the previous paragraphs and I know the nature of the activities atFly Tri Racing, LLC, I understand the demands of those activities relative to my physical condition and skill level, and I appreciate the types of injuries, which may occur as a result of activities made possible at Fly Tri Racing, LLC. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.Acknowledgement of Understanding: I have read this assumption of risk and fullunderstand its terms. I acknowledge that I am signing freely and voluntarily and intendmy signature to signify a complete assumption of the inherent risks of participating orobserving recreational activities at Fly Tri Racing, LLC to the greatest extent allowed by law in the State of Texas. *

WAIVER AND RELEASE OF LIABILITY FOR MINOR PARTICIPANTS IN CONSIDERATION of my child being allowed to participate in any way in the Fly Tri Racing, LLC coaching program, related events and activities, the undersigned parent(s) or legal guardian(s), acknowledges, appreciates, and agrees that:1. The risk of injury to my child from the activities involved in these programs is significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Fly Tri Racing, LLC or others, and assume full responsibility for my child's participation; and,3. I willingly agree to comply with the program's stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child's readiness for participation and/or in the program itself, I will remove my child from the participation and bring such attention of the nearest official or coach immediately; and,4. I, for myself on behalf of my/our heirs, assigns, personal representatives and next of kin, hereby release the other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event, hereafter referred to as Releasees, with respect to any and all injury, disability, death, or loss or damage to person or property incidental to my child's involvement or participation in these programs, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.5. I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, hereby agree to assume the risk and hold harmless, release, and otherwise indemnify Fly Tri Racing, LLC, its officers or agents, its affiliated organizations and sponsors and the owners of, in the performance of said fields and facilities utilized for the programs, from any liability from any and all liabilities incidental to my involvement or participation in these programs, even if arising from their negligence, to the fullest extent permitted by law.I have read this release of liability and assumption of risk agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement. Fly Tri Racing, LLC MINOR RELEASE FOR PARTICIPANT UNDER AGE 18 I, THE MINOR’S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF FLY TRI RACING, LLC ACTIVITIES AND THE MINOR’S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE’S FROM ALL LIABILILTY CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNITY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM.
Media Release:  I give Fly Tri Racing, LLC and people acting for and with Fly Tri Racing, LLC permission to interview, photograph, video, and /or audio record me to use and to edit, without compensation to me, the items listed below in any medium, including print and electronic (web based) material for educational, promotional, analysis and marketing purposes: Photographs or video footage of me.  Spoken (written or recorded) interviews of me and quotes from me My full name in connection to the photographs, video footage, interview or quotes and My location in connection with the photograph(s), video footage, interviews or quotes.I will make no monetary or other claim in connection with the authorized use of my name or photos, video, interviews and quotes, and I now release Fly Tri Racing, LLC and partner organizations and their employees and/or partners in education, promotion, publicity and marketing interviews from any claims, demands and liabilities in connection with the use authorized and agreed by here by me. *
