Acceptance of Responsibility and Release from Liability

The Center for Wooden Boats seeks to present programs that are as safe, educational and fun as possible. The following information is not designed to diminish enthusiasm for our programs, yet we want participants to know in advance what some of the potential risks are.

Awareness and Assumption of Risks
Recognizing that The Center for Wooden Boats will do its best to ensure a safe experience, Participants understand that there are risks and hazards inherent to  participation in the activities of this program. Some of the risks include, but are not limited to serious bodily injury or death, cuts, broken bones, sprains, head injuries, heat exhaustion or heat stroke and drowning. Participants agree to assume these risks. To reduce the chance of injuries, Participants must follow safety instructions and refrain from behavior that is harmful to themselves and others.

Participants understand that it is their responsibility to provide for their own accident and health coverage while participating in this program and  further understand that The Center for Wooden Boats does not provide any coverage whatsoever for participants, whether a minor child or adult.

Authorizations

Medical Treatment
Participants release and forever discharge The Center for Wooden Boats from any claim which arises or may hereafter arise on account of first aid, treatment, or any services rendered in connection with their activities with The Center for Wooden Boats or with the decision by any representative or agent of The Center for Wooden Boats to exercise the power to consent to medical or dental treatment arising out of any injuries suffered while participating  in any such activities.



Media Waiver

Participants understand that pictures and video may be taken  during participation in such activities and participants give permission for The Center for Wooden Boats to use these images for promotional purposes.

Cancellation Policy

For Chesapeake Light Craft Boatbuilding Courses, the following cancellation policy applies:

• Cancellation/change outside of 60 days = full refund less $50 admin fee.
• Cancellation/change within 60-45 days prior to start date = a $50 admin fee and tuition credit for the remaining amount towards a course within the same calendar year. There is no cash refund. Kit Purchase will be refunded less $50 Admin fee on condition of Chesapeake Light Craft not having shipped yet. Participant must take ownership of purchased boat kit if shipped.
• Cancellation/change within 45-30 days of start date = 50% tuition credit of tuition available towards a course within the same calendar year. There is no cash refund. Kit Purchase will be refunded less $50 Admin fee on condition of Chesapeake Light Craft not having shipped yet.  Participant must take ownership of purchased boat kit if shipped.
• No refund or credit available for tuition 30 days or less to start of program. Participant must take ownership of purchased boat kit

In case of emergency or insufficient number of registrations, CWB reserves the right to cancel a course and refund the participants in full.

Because of this policy, we strongly urge you to buy refundable airline tickets or flight insurance. CWB will not be responsible for any loss on non-refundable airline tickets.

Release and Hold Harmless

Participants hereby agree to release and hold harmless, The Center for Wooden Boats, its employees, volunteers and agents from any and all responsibility and liability of any nature whatsoever, including claims for injury, illness, death, loss or damage, resulting from my  participation in any Center for Wooden Boats activity. If any portion of this release is held to be invalid, I agree that the remaining terms shall continue to be in full legal force and effect.
Participants understand that this Release forever discharges The Center for Wooden Boats from any liability or claim whatsoever that they may have against The Center for Wooden Boats with respect to any bodily injury, personal injury, illness, death, or property damage that may result from activities undertaken with The Center for Wooden Boats, whether caused by the negligence of The Center for Wooden Boats, its employees, directors, officers, or agents or otherwise. Participants understand that The Center for Wooden Boats is not responsible to provide any financial compensation whatsoever related to medical, health, or disability insurance n the event of injury or illness.  

CCVID-19 waiver

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization.
COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result,
governments and public health agencies recommend social distancing and have, in many locations, prohibited the
congregation of people.
The Center for Wooden Boats (“CWB”) has established preventive measures to reduce the spread of COVID-19;
however, CWB cannot guarantee that you, or any minor children for whom you are responsible, will not become
infected with COVID – 19. Further, engaging in any CWB activity could increase your risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I
and any minor child for whom I am responsible may be exposed to or infected by COVID-19 by visiting and
participating in activities at CWB and that such exposure or infection may result in personal injury, illness,
permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at CWB
may result from the actions, omissions, or negligence of others, and myself including , but not limited to: CWB
employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to me or minor
child for whom I am responsible (including , but not limited to, personal injury, disability , and death), illness,
damages, loss, claim, liability , or expense of any kind that I or minor child for whom I am responsible, may
experience or incur in connection with participation in activities at CWB (“Claims”). On my behalf, and on the behalf
of any minor child for whom I am responsible, I hereby release, covenant not to sue, discharge, and hold harmless
CWB, its employees, agents, and representatives , of and from the Claims, including all liabilities, claims, actions,
damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release
includes any Claims based on the actions, omissions, or negligence of CWB, its employees, agents, representatives,
whether a COVID-19 infection occurs before, during , or after participation in any CWB activity.
I, the undersigned participant, affirm that I am  freely signing this
Agreement. I certify that I have read this agreement, that I fully understand its content and that this release cannot
be modified orally. I am aware that this is as release of liability and a contract and that I am signing it of my own
free will.

Entire Agreement

Participants, and The Center for Wooden Boats certify that this Release represents the entire agreement between the parties. This agreement shall be governed by the laws of the State of Washington and is meant to be as broad and inclusive as permitted by the laws of the State of Washington.
