Equipment Rental Agreement between Zenith Sport Sciences/ZSS Paddling Equipment and Renter.

Key: Zenith Sport Sciences/ZSS Paddling Equipment - herein called ZSS. Undersigned - herein called the Renter, person renting the equipment. Equipment - herein means the equipment being rented such as (but not limited to) skis, kayaks, paddles, helmets, PFDs, leashes.

Care of Equipment - Do not place equipment on hard surfaces e.g. road, concrete, rocks. Do not drag equipment at any time. Do not leave equipment unattended.

1. Renter shall obey all state and local boating/marine regulations, and all lawful directives from appropriate emergency or law enforcement personnel, while operating a Water Craft rental. In the event of a fine for violation of these rules the renter shall be solely responsible. Renter agrees to immediately notify ZSS of any incidents or injuries occurring while renting the Water Craft(s), and/or Equipment.

2. Renter confirms that he or she is capable of operating the equipment and finds it in good working order, condition and repair at time of rental.

3. Renter is responsible for damage/theft/loss of any and all equipment caused by their own negligence, carelessness or other. The Renter agrees to reimburse ZSS for any equipment damaged, stolen or loss caused by my neglect and to pay for any and all repairs or replacement charges, to ZSS's satisfaction.

4. Recognition of Risk; Renter expressly acknowledges that use of Water Craft is an activity with inherent risks of injury to persons and property; Renter is aware of those risks and understands them. Renter acknowledges that life jackets are made available for use while renting a water craft, and that all participants are required to wear life jackets while operating a rented water craft. Renter understands that use of a life jacket does not remove all risks of injury; nor does it make kayaking, paddle boarding or paddle boating a safe activity. Renter alone has determined the sufficiency of any safety gear or other precautions that Renter decides to take to minimise the risks of the activity. No party related to ZSS, including Owner and Employees, has made any representations regarding the safety of, or the risks of, the activity. Renter expressly assumes the risks of the activity.

5. Release of Liability; Renter hereby RELEASES ZSS, its owner, volunteers and its employees from liability for negligence, and holds harmless ZSS, its owner, volunteers and its employees from any loss, expense or cost, including attorney fees, arising out of any damages or injuries, whether to persons or property, occurring as a result of the rental or use of said equipment. This agreement constitutes the entire agreement between ZSS and Renter and no term may be waived or modified (including this provision against oral modification) except in writing signed by both parties. There are no warranties, expressed or implied, by ZSS to Renter, except as contained herein, and ZSS shall not be liable for any loss or injury to Renter nor to anyone else, of any kind or however caused. This agreement is one of bailment only and Renter is not an ZSS agent while using said Equipment.

Rental payments are to be paid in advance. ZSS will contact the Renter to confirm requirements and rental cost. Renter credit card details will be held in a PCI compliant application as security. All equipment will be checked before the Renter takes possession and when returned. Should there be any damage/loss/theft then the Renter will be advised immediately and Renter's credit card may be charged. We appreciate your understanding with this matter.
