INFORMED CONSENT, RISK ACKNOWLEDGEMENT, RELEASE OF LIABILITY &
INDEMNITY AGREEMENT*
I understand that during my participation in the Nova Scotia Nature Trust Guided Hike I will be exposed to situations and environmental conditions which
will be different and more challenging than those which I normally encounter.
More specifically I acknowledge and understand that I will be hiking over
terrain that may be uneven, rough, wet, slippery and muddy, in all types of
weather conditions. I also acknowledge that although the Nature Trust is taking
precautions to provide proper organization, supervision, instruction, and care
during the Guided Hike, circumstances may arise which are not foreseeable, or
which are beyond the control of the Nature Trust. I acknowledge that the Nature Trust cannot guarantee my safety or well-being and I agree to comply with the
instruction and directions given to me by Hike Leaders, volunteers of the Nova
Scotia Nature Trust. I, hereby indemnify and hold harmless the Nova Scotia
Nature Trust, their agents, volunteers, and employees from and against all
claims, demands, losses, costs, damages, actions, suits, or proceedings,
relating to either injury or my death, arising out of or attributable to my
participation in the Nova Scotia Nature Trust Guided Hike. This indemnification shall include
negligence or breach of any statutory or other duty of care, including the duty
of care under the Occupiers Liability Act. I am aware of the nature and effect
of this Informed Consent, Risk Acknowledgment and Release of Liability and
Indemnity Agreement and I acknowledge having read this form before signing it.
This Agreement shall be governed and interpreted in accordance with the laws of
the Province of Nova Scotia. Any litigation involving the parties shall be
brought in the Province of Nova Scotia.
