RELEASE FOR MINOR PARTICIPANTS – 2021/2022

READ BEFORE REGISTERING

IN CONSIDERATION OF my child/ward listed above, being allowed to participate in any way in basketball and other sports related events and activities (collectively, the “Activities”) led by Gamepoint Basketball (“Gamepoint”) and Dickinson Cameron Construction Company Inc, (“Dickinson”) on the premises located at 1248 Los Vallecitos Boulevard, San Marcos, Ca 92069 (the “Premises”), the undersigned acknowledges, appreciates, and agrees that:

A. The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) to my child from the activities involved in these programs are significant and serious, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,

FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, assume full responsibility for my child’s participation and accept personal responsibility for the damages following such injury, permanent disability or death; and,
I willingly agree to comply with the instructions given for such participation. If I observe any unusual significant concern in my child’s readiness for participation, I will remove my child from the participation and bring such attention of the nearest official immediately; and,
I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS (1) Gamepoint and each of Gamepoint's employees, shareholders, officers, directors, agents, attorneys, insurance carriers, parents, subsidiaries, divisions or affiliated organizations or corporations, whether previously or hereafter affiliated in any manner, and the respective predecessors, successors and assigns of all of the foregoing, (2) Dickinson and each of Dickinson's employees, officers, directors, agents, attorneys, insurance carriers, parents, subsidiaries, divisions or affiliated organizations or corporations, whether previously or hereafter affiliated in any manner, and the respective predecessors, successors and assigns of all of the foregoing, whether previously or hereafter affiliated in any manner, and the respective predecessors, successors and assigns of all of the foregoing (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to my child/ward’s involvement or participation in the activities at the Premises, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
I, for myself, my spouse, my child/ward, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.
I understand that the Releasees do not provide medical insurance in such activities. Therefore, I represent that my child/ward is in proper physical condition with no known medical condition or problem that could limit his or her ability to safely participate in the Activities on the Premises.
COVID-19: Due to the 2019-2022 outbreak of the novel Coronavirus (COVID-19), if you or your child/ward are experiencing any of the following symptoms, we ask that you stay home. Symptoms of COVID-19 as stated by the CDC include: cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, and new loss of taste or smell.

I understand the above symptoms and affirm that my child/ward, as well as all household members, do not currently have, nor have experienced the symptoms listed above WITHIN THE LAST 14 DAYS. I affirm that my child/ward, as well as all household members, have not been diagnosed with COVID-19 WITHIN THE PAST 30 DAYS. I affirm that my child/ward, as well as all household members, have not knowingly been exposed to anyone diagnosed with COVID-19 WITHIN THE PAST 30 DAYS. I affirm that my child/ward, as well as all household members, have not traveled outside of the country, or to any city considered to be a “hot spot” for COVID-19 infections WITHIN THE PAST 30 DAYS. I will update the Releasees if these circumstances change prior to any participation in Activities. I understand that Releasees cannot be held liable for any exposure to the COVID-19 virus and assume all risk.

I, and for my spouse and child/ward, without compensation to me or my child listed, hereby grant permission to Gamepoint and Dickinson the absolute and irrevocable right and permission, with respect to photographs, videos, and audio recordings taken or made of and/or comments made by the above-named student or in which the student may be included with others; to use, re-use, and publish the same in whole or in part in any and all media including use on the world wide web, now or hereafter, and for any purpose whatever for illustration, promotion, art, recruitment, publication, advertising, and trade, and if appropriate, to use the student’s name. Use of photographs, videos, comments, and audio recordings is granted without any restriction as to changes or alterations (including but not limited to composite or distorted representations or derivative works made in any medium) and I waive any right to inspect or approve the finished versions incorporating the photograph, video, audio recording, and/or comments including written copy that may be created and appear in connection therewith as long as the material is within reason and is not deemed to be socially inappropriate for use. I release and discharge Gamepoint and its employees, assigns, licensees, successor in interest, and legal representatives from any and all claims and demands arising out of or in connection with the use of these photographs, videos, audio recordings, and/or comments, including without limitation any and all claims for libel or invasion of privacy. The photographs, videos, audio recordings, and/or comments will not be sold to any other firm or organization.
