Please read and agree to the terms of our liability waiver below.

By participating in class(es) at Decidedly Jazz Society, operating as Decidedly Jazz Danceworks (“DJD”), I agree that:

1. RISK OF SERIOUS INJURY: I understand and agree that:

a. My participation in dance school lessons (in person or virtually) and the use of the facilities of DJD is a potentially dangerous activity that might involve physical injury or pain, being hit or colliding with another dancer, prop, lighting or any piece of a production set. I might also experience exhaustion, dehydration, slipping, falling, exposure to other dancers, teachers, third parties, pulled muscles, torn ligaments or tendons, broken or sprained bones, cuts and bruises.

b. There is the possibility of serious physical or mental trauma or injury (e.g. paralysis) to me or others, even death, associated with participation in the lessons (in person or virtually) and use of the facilities.

2. MY HEALTH. I am capable of safely participating in the lessons (in person or virtually) and use of the facility. I have the mental and physical health to safely do so. It is my responsibility as participate to safely stop participating if I feel at all unwell.

3. I RELEASE DJD. I hereby agree as follows:

a. I release DJD, its affiliates and each of their, directors, instructors, officers, employees, representatives, and other guests (the “Releasees”) from all actions, claims, costs,
demands and/or liability whatsoever arising from or related to my participation, use of DJD’s facility, or due to DJD’s negligence, any other tort action, breach of contract, breach of any occupier’s liability legislation, breach of any other applicable law, and breach of any other civil or strict liability with respect to my participation (the “Claims”). I understand that negligence includes DJD’s failure to safeguard or protect me from the risks, dangers and hazards of using the facility and participating in the lessons (in person or virtually).

b. I also agree to indemnify the Releasees for all Claims brought against or suffered by the Releasees, as a result of my use of the facilities or participation in the lessons (in person or virtually).

4. I am an adult. I have read and understood this waiver and I am aware that by signing this waiver, I am assuming physical and mental risk and waiving my legal rights which I or my heirs, next of kin, executors, administrators or assigns may have against the Releasees.

5. POLICIES. I am aware of:

6. INCLUSIVITY. DJD is an inclusive space. Please treat everyone
with respect. There is a zero-tolerance policy for harassment or abuse toward team members and fellow clients based on any grounds of discrimination including without limitation: race, colour, ancestry, place of origin, religious beliefs, gender, gender identity, gender expression, age, physical disability, mental disability, marital status, family status, source of income and sexual orientation.

7. CARE. I am responsible for not damaging the facilities and leaving it in the same condition that I received it. If not, I will pay for all repairs or replacement if damaged.

8. PHOTO AND VIDEO. I understand that my voice, name, and image might be recorded by various mechanical and electronic means of all descriptions, such as recording in whole or in part by videography, including all reproductions of such recording, along with the use of my name, hereinafter collectively referred to as the “Image”. I agree that DJD, and any person with DJD’s permission, may freely record, use, make digital images of or otherwise reproduce, modify, and/or publish, all or part of the Image in any media anywhere in the world for any proper commercial, educational, charitable, or artistic purposes, with or without my name or a fictitious name, and with or without other material, including text and other images.

9. I understand that I do not own the copyright in the Image or have any other right, interest in or to it and I confirm that I did not commission the Image (privately or otherwise).

10. I hereby waive and release DJD, and any person acting with DJD’s permission, from any claims relating to DJD’s recording, use, modification, digital images, publishing and/or reproduction of the Image as set out above, including but not limited to claims for libel, slander, invasion of privacy, copyright, or payment of any kind.

As the parent or guardian of the child or children participating in class(es) at Decidedly Jazz Society, operating as Decidedly Jazz Danceworks (“DJD”), I agree that:

b. There is the possibility of serious physical or mental trauma or injury (e.g. paralysis) to my child or others, even death, associated with participation in the lessons (in person or virtually) and use of the facilities.

12. MY HEALTH. I warrant that my child is capable of safely participating in the lessons (in person or virtually) and use of the facility and has the mental and physical health to safely do so. It is my responsibility to prevent my child from participating if they feel at all unwell.

13. I RELEASE DJD. I hereby agree as follows:

a. I release DJD, its affiliates and each of their, directors, instructors, officers, employees, representatives, and other guests (the “Releasees”) from all actions, claims, costs,
demands and/or liability whatsoever arising from or related to my child’s participation in dance school lessons (in person or virtually), or due to DJD’s negligence, any other tort action, breach of contract, breach of any occupier’s liability legislation, breach of any other applicable law, and breach of any other civil or strict liability with respect to my child’s participation (the “Claims”). I understand that negligence includes the DJD’s failure to safeguard or protect me from the risks, dangers and hazards of using the facility and participating in the lessons (in person or virtually).

b. I also agree to indemnify the Releasees for all Claims brought against or suffered by the Releasees, as a result of my child’s use of DJD’s facilities or participation in the dance lessons.

14. I have read and understood this waiver and I am aware that by signing this waiver, there is an assumption of physical and mental risk and on behalf of my child I am waiving their and my legal rights which I, my child, or my heirs, next of kin, executors, administrators or assigns may have against the Releasees.

17. CARE. I agree I am responsible for my ensuring my child does not damage the facilities and that they leave it in the same condition that it was received. If not, I will pay for all repairs or replacement if damaged.

I understand that my child’s voice, name, and image might be recorded by various mechanical and electronic means of all descriptions, such as recording in whole or in part by videography, including all reproductions of such recording, along with the use of my child’s name, hereinafter collectively referred to as the “Image”. I agree that DJD, and any person with DJD’s permission, may freely record, use, make digital images of or otherwise reproduce, modify, and/or publish, all or part of the Image in any media anywhere in the world for any proper commercial, educational, charitable, or artistic purposes, with or without my child’s name or a fictitious name, and with or without other material, including text and other images.

19. I understand that neither I nor my child own the copyright in the Image or have any other right, interest in or to it and I confirm that neither I nor my child commissioned the Image (privately or otherwise).

20. I hereby waive and release DJD, and any person acting with DJD’s permission, from any claims relating to DJD’s recording, use, modification, digital images, publishing and/or reproduction of the Image as set out above, including but not limited to claims for libel, slander, invasion of privacy, copyright, or payment of any kind.
