THIS RELEASE AND WAIVER OF LIABILITY (the “Release”) is executed on the date below, by the undersigned Adult Volunteer (the “Participant”) in favor of Pheasants Forever Inc., Quail Forever, Trout Unlimited and Eagle Bluff Learning Center and each of their respective directors, officers, trustees, employees, volunteers, insurers and agents (collectively, the “Released Parties”). Participant freely, voluntarily and without duress execute this Release under the following terms: Participant desires to enroll in T.U.N.E. Camp where Participant will engage in the activities related to attendance at T.U.N.E. Camp which is operated by one or more of the Released Parties (the "Activities"). Participant understands that the Activities may include but are not limited to the following: being in outdoor habitat areas; traveling to and from Activity sites; consuming food available or provided; and carrying out indoor and outdoor nature and sporting activities such as fly fishing, shooting sports, high ropes, archery, canoeing, raptor bird experiences, wildlife and plant ecology activities, orienteering and survival activities, campfires etc.

RELEASE AND WAIVER. Participant releases and forever discharges and holds harmless the Released Parties and their successors and assigns from any and all liability, claims and demands which I or my heirs, assigns, next of kin or legal representatives may have or which may later accrue with respect to any bodily injury, personal injury, illness, death or property damage that arises from or is in any way related to my Activities with any of the Released Parties, whether caused wholly or in part by the simple negligence, fault or other misconduct, other than intentional or grossly negligent conduct, of any of the Released Parties or of other Participants. Participant understands that under this Release, Participant knowingly assumes the risk of injury, harm and loss associated with the Activities. Participants also understands that the Released Parties do not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of injury, illness, death or property damage.

MEDICAL TREATMENT. Participant releases and forever discharges the Released Parties from any claim or action that arises or may arise later on account of any first aid, treatment or similar service rendered in connection with my Activities with the Released Parties or with the decision by any representative or agent of the Released Parties to exercise the power to consent to medical or dental treatment as such power may be granted and authorized in the Eagle Bluff Environmental Learning Center Camper Medical Release Form.

ASSUMPTION OF THE RISK. Participant understands that Activities may include things that may be hazardous, including, but not limited to, the following: inclement weather, walking on uneven trails or uneven ground, being in outdoor habitat areas; traveling to and from Activity sites; and carrying out indoor and outdoor nature and sporting activities such as fly fishing, shooting sports, high ropes, archery, canoeing, raptor bird experiences, wildlife and plant ecology activities, orienteering and survival activities, campfires and other people’s behavior. Participant also understands there is some inherent risk in consuming any foods made available by the Released Parties. Participant expressly and specifically assumes the risk of injury or harm in the Activities and release the Released Parties from all liability for any loss, cost, expense, injury, illness, and death or property damage resulting directly or indirectly from the Activities and agree to indemnify defend and hold harmless the Released Parties.

FIREARMS RISK. In addition to the above, Participant further understands that firearms and archery equipment are inherently dangerous and by their very nature may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. Participant understands that certain risks, dangers, and injuries due to inadequate or defective equipment, and all other potential dangers inherent to activities involving firearms and archery equipment exist. Participant and the estate, heirs, assigns and next of kin of Participant, waive all claims for damages, injuries or death sustained to Participant that may arise against the Released Parties caused by the Released Parties negligence (including acts of ordinary or gross negligence), but excepting intentional acts or willful or wanton misconduct.

INSURANCE. Participant understands that, except as otherwise agreed to by the Released Parties in writing, the Released Parties are under no obligation to provide, carry or maintain health, medical, travel, disability or other insurance coverage for any Participant. Each Participant is expected and encouraged to obtain his or her own health, medical, travel, disability or other insurance coverage.

PHOTOGRAPHIC RELEASE. Participant grants to Pheasants Forever, Inc., Quail Forever, Trout Unlimited and Eagle Bluff Learning Center and any other affiliated organization, all right, title and interest in any and all photographs and video or audio recordings of or including my image or voice (“Photographs”), made by any of the Released Parties during my Activities with the Released Parties, including, but not limited to, the right to use the Photographs for any purpose and to any royalties, proceeds or other benefits derived from them.

OTHER. Participant expressly agrees that this Release is to be interpreted under Minnesota law and is intended to be as broad and inclusive as permitted by Minnesota law. Participant agrees that if any provision of this Release is held to be invalid by any court, the invalidity of that provision will not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. Further, a waiver of a right under this Release does not prevent the exercise of any other right.
