​Terms and Conditions

Class Cancellations: In rare instances, a class that you signed up for may be canceled by the coach for the upcoming or current session. If this occurs we will try to find another class time that you can attend. If we can’t find an available class to switch to, then you will receive a refund. Missed classes and make-Ups: Make-ups will only take place if there is a second day in which the class is held, and must be completed during the current session. There are no refunds or credits for missed classes. Parents are encouraged to notify the coach in advance if they will be absent for an upcoming class so that more make-up slots will be available for other students. Cancellations and Refunds: A full refund will be granted if the student cancels their attendance prior to the start of a new session. No refunds will be granted once the session has started. Inclement Weather: Indoor classes will still take place if it’s raining. If a class needs to be canceled by the coaching staff for inclement weather, you will be notified via text, email or phone call. Please wait to hear from the coaching staff, as they will most likely be coaching when you call or text and they will not be able to reply. Make-up classes will be scheduled for cancellations due to bad weather. Change of Information: To protect the welfare and safety of all children, please notify us in writing of any change in address, telephone number, caregiver information or emergency contact. Photo & Video Release: I agree to allow Sarasota Tennis and Fitness to use video or photos taken of my family for archival and publicity purposes.Payment: We accept cash, check, or online payment (if paying online please use paypal or venmo). Returned checks have a fee of $35.Please make checks payable to Sarasota Tennis and Fitness. Payment is due prior to the start of a new session. Registration is not complete and class placement is not guaranteed unless payment has been received. Payments received after the first class will have a $25 late fee.

Liability Waiver

In consideration for being permitted to utilize and/or being granted access to the facilities, amenities, and services located at Sarasota Tennis and Fitness (PREMISE) , the undersigned (Guest) for himself and/or minor child and/or visitors accompanying Guest.1. HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Sarasota Tennis and Fitness, other participants, any other person on the PREMISE, surveyors, underwrites, brokers, consultants and others who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the PREMISE and/or tennis/fitness program and for each of them, their directors, coaches, officers, agents and employees, all for the purposes herein referred to as “Releases”, FROM ALL LIABILITY TO THE UNDERSIGNED, his personal representatives, assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH AND/OR INJURY OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE TENNIS / FITNESS PROGRAM, OR FROM THE PREMISES ITSELF, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.2. HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS COMPANY OWNERS FROM ANY LOSS, LIABILITY, DAMAGE, OR COST INCLUDING BODILY INJURY OR PROPERTY DAMAGE, that may occur arising out of my or my minor child’s presence or participation in Sarasota Tennis and Fitness, tennis and/or fitness program, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.3. HEREBY ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE arising out of or related to Sarasota Tennis and Fitness' Tennis and/or fitness program whether caused by the NEGLIGENCE OF THE RELEASEES or otherwise, and whether such risks are inherent to the program or not, while present at Sarasota Tennis and Fitness. HEREBY agrees that this Release and Waiver of Liability, Assumption or Risk and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the laws of the State of Florida and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTENDED MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
