1. No allowance has been made for any works to be carried out outside normal working hours (7.30am – 4.30pm, Monday to Friday) or on Public Holidays.
2. Unless otherwise stated, no allowance has been made for provision of special access equipment if required.
3. Unless otherwise agreed in writing, charges for work performed are based on having continuous, uninterrupted, and unhindered access to the required people, equipment, facilities, and areas where the work is to be carried out.
4. No allowance has been made for extraneous work, patching, carpet lifting or refitting, building works or decoration, should LSB Solutions agree to carry out such work at the request of the customer then LSB Solutions will not be liable for any damage arising.
5. No allowance has been made for the provision of As Installed Drawings by LSB Solutions. The customer accepts any and all terms and conditions provided by sub/contractors.
6. Limitation of Liability: Subject to the clause “Warranty” above, LSB Solutions shall not be under any liability, whether in contract, tort, or otherwise from any cause whatsoever, whether occasioned by negligence or otherwise for any injury, damage or loss including consequential damage or loss whether to persons or property arising out of this contract.
7. All efforts will be made to ensure vehicles do not come in contact with any job materials, however due to the restricted area, should this arise LSB Solutions take no responsibility beyond the immediate vicinity of the job as outlined in description of works.
8. LSB Solutions is not responsible for removing or cleaning contaminated material in or about the site on which the works or any part thereof to be performed.
9. In the event that LSB Solutions incurs any liability as a result of discovery of any undisclosed asbestos materials, the Customer must indemnify LSB Solutions for any such liability.
10. Cancellation of Order
(a) No Order may be cancelled except with LSB Solutions consent in writing and on terms which fully indemnify LSB Solutions against all of its losses resulting from such cancellation.
(b) Where the cancellation of an Order has been accepted by LSB Solutions:
(i) deposits will not be refundable;
(ii) the refund of monies other than deposits are at LSB Solutions’ absolute discretion.
11. Payment
Upon completion of works payment is due immediately. If payment is not made at that time and is not received within 24 hours the card on file will be charged unless another written agreement is made prior to this time.

Upon delivery of materials, where material cost makes up the bulk of the quotation, the cost of materials is due. For jobs over 5k, upon completion of rough in, fit off or all works, the balance of each invoice is due within 7 days. Late payments will incur a 10% late fee. If payment can not be made within this time, a written payment extension request must be submitted to LSB Solutions at least 4 days prior to payment due date.
12. Indemnities
(a) The Customer indemnifies LSB Solutions against any and all losses, claims or damages arising whether directly or indirectly out of or in relation to the Customer or any of its servants or agents breaching these Terms and Conditions, and any negligence, misconduct or
default by the Customer or its servants or agents.
(b) The Customer will not cause, or authorise or allow its servants or agents to cause, anything which will damage or threaten LSB Solutions or the business or the goodwill attached to the business of LSB Solutions.
13. Title to the products
(a) LSB Solutions supplies the products on the condition that property in the products will not pass to the Customer until they have been paid for in full by the Customer including any and all late payment fees incurred. LSB Solutions reserves the following rights in relation to the products until all monies owed by the Customer to LSB Solutions with respect to such products are fully paid:
(i) ownership of the products;
(ii) to enter the Customer's premises (or the premises of any associated company or agent where the products are located) without liability for trespass or any resulting damage and retake possession of the products; and
(iii) to keep or resell any products repossessed pursuant to sub-clause 13(a)(ii) above.
(b) If the products are resold, or property incorporating the products are sold, by the Customer, the Customer shall hold such part of the proceeds of any such sale as represents the price of the Order in a separate identifiable account as the beneficial property of LSB Solutions and shall pay such amount to LSB Solutions upon request.
(c) Notwithstanding sub-clauses 13(a) and (b), LSB Solutions shall be entitled to maintain any action against the Customer.
(d) Notwithstanding sub-clauses 13(a) and (b), the risk of loss or damage to the products shall pass to the Customer upon delivery.
14. Jurisdiction
(a) The Agreement is made in the States of Queensland and New South Wales, Australia.
(b) The parties submit all disputes arising between them to the Courts of the State of Queensland and New South Wales and any Court competent to hear appeals from those Courts of first instance.
15. Severability
If any provision(s) of these Terms and Conditions is invalid, illegal or unenforceable in any respect, then such provision(s) shall be severed and the remaining provisions shall remain in full force and effect.
