AGREEMENT TO PARTICIPATE:

Knowing that there may be dangers, hazards, and risks associated with such an Activity, and in consideration of being permitted to participate in the Activity, on behalf of myself, my family, my heirs, and personal representative(s), I, the undersigned, being of adult age, on behalf of myself and any minor children for whom I am a parent, legal guardian, or otherwise responsible, agree to assume all the risks and responsibilities surrounding my participation and any such minor children’s participation in the Activity, the transportation, and in any independent research or activities undertaken as an adjunct thereto. My participation in these activities is purely voluntary and I elect to participate in spite of and with full knowledge of the inherent risks. I have no physical or medical condition which would endanger others or myself if I participate in any Activity, or would interfere with my ability to participate in any Activity. The minor children for whom I am a parent, legal guardian, or otherwise responsible do not have any physical or medical condition which would endanger others or themselves if they participate in any Activity, or would interfere with their ability to participate in any Activity.

SIGNAURE:

RELEASE, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT :

I, the undersigned, in consideration for the use of the facilities (that includes, but is not limited to instruction and the use of fitness and other equipment) at Lehigh Carbon Community College Fitness Center (the “Center”), which involves the risk of injury to me whether you or someone else causes it, for myself, and any minor children for whom I am parent, legal guardian, or otherwise responsible and my personal representatives, assigns, heirs and next of kin: HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the Lehigh Carbon Community College, its Sponsors, Trustees, officers, employees, volunteers, and agents, for purposes herein all referred to as RELEASEES, from all liability to me, my personal representatives, assigns, heirs and next of kin for all loss or damages, and any claim or demands therefore, on account of injury to the person or property or resulting in the death of me, whether caused by the negligence of Releases or otherwise and/or from the use of the facilities by me or while in, on, upon or in transit to or from the Center, or any adjunct to the Activity; and I HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releases and each of them from any loss, liability, damage or cost they may incur due to my participation in the Activity and the use of the facilities by me, the negligence of Releases, or otherwise. I expressly agree that the foregoing Release, Waiver of Liability, and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the laws of the Commonwealth of Pennsylvania and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. I warrant the following statements are true and correct and understand that the Releases have relied on them in entering into the foregoing Release, Waiver and Indemnity Agreement and in giving me permission to enter into the Center and to use the facilities. No oral representations, statements or inducements apart from the foregoing written agreement have been made. I assume full responsibility and risk of bodily injury, death, or property damage due to negligence of Releases or otherwise in the use of the facilities. I understand and agree that Releases exclude any implied warranties of merchantability and fitness for products and equipment presented for use by Releases. I HAVE READ AND VOLUNTARILY SIGN THE RELEASE, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT.
